WHEREAS, the Municipal Council of the City of Newark on August 1, 2012, pursuant to Resolution No. 7R5-A, authorized the Mayor and/or his designee the Director of Finance to enter into a contract with Malcolm Pirnie - Arcadis U.S., Inc., 17-17 Route 208 North, Fair Lawn, New Jersey 07410, for a total amount not to exceed $45,000.00, to conduct a water and sewer rate study for the City of Newark, as the only responsible and lowest bidder, in accordance with the RFP Specifications; and
WHEREAS, the Resolution and Professional Services Agreement provide that the term of the contract will be established for a four (4) month term pursuant to N.J.S.A. 40A:11-3(b); and
WHEREAS, the water and sewer rate study for the City of Newark will not be completed by October 19, 2012; and
WHEREAS, the Department of Finance is requesting authorization to enter into a First Amended Contract with Malcolm Pirnie - Arcadis U.S., Inc., to extend the contract period to complete the water and sewer rate study for the City of Newark to February 19, 2013; and
WHEREAS, the Mayor of the City of Newark signed into law Executive Order Number MEO-07-0001 (hereinafter "Pay-to-Play Executive Order"), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of Finance, are hereby authorized to enter into and execute a First Amended Contract, in the form attached hereto, with Malcolm Pirnie - Arcadis U.S., Inc. located at 17-17 Route 208 North, Fair Lawn, New Jersey 07410, to extend the period of the contract from June 20, 2012 to October 19, 2012 to June 20, 2012 to February 19, 2013, to complete the water and sewer rate study for the City of Newark.
2. No additional funds shall be awarded to the Malcolm Pirnie U.S.,Inc. under this First Amended Contract.
3. No additional work or assignments other than the water and sewer rate study required under the Contract shall be given to Malcolm Pirnie - Arcadis U.S., Inc. under this First Amended Contract.
4. This resolution and a fully executed copy of the First Amended Contract shall be filed with the Office of the City Clerk by the Director of the Department of Finance.
5. All other terms and conditions contained in the Contract authorized
pursuant to Resolution No. 7R5-A, and adopted on August 1, 2012 shall remain in full force and effect and in accordance with the law unless amended herein.
STATEMENT
Resolution ratifies and authorizes the Mayor and/or his designee, the Director of Finance to enter into and execute a First Amended Contract with Malcolm Pirnie - Arcadis U.S., Inc., located at 17-17 Route 208 North, Fair Lawn, New Jersey 07410, to extend the contract term from June 20,2012 to October 19, 2012 to June 20, 2012 to February 19, 2013, to complete the water and sewer rate study for the City of Newark.
