WHEREAS, the Newark Municipal Council is of the opinion that the cost of operating the Water and Sewer department of the City of Newark along with the associated watershed properties can and should be managed by employees that work for the City of Newark; and
WHEREAS, the residents of the City of Newark agree with the position of the Municipal Council as demonstrated through the recent initiative ordinance advanced by a group of citizens with the support of over five thousand (5,000) residents; and
WHEREAS, the Administration following several request to do so, has failed to produce any documentation that would dispute the position of the Municipal Council; and
WHEREAS, the current operation of the Water and Sewer Department of the City of Newark is being hindered by the lack of a qualified, full time director of the department; and
WHEREAS, the Administration of the City of Newark has failed/refused to hire a full time Director for the Water and Sewer Department, in spite of numerous requests by the Municipal Council. And
WHEREAS, Newark Mayor Cory A. Booker is using his power of “Executive Order” to allow the Newark Watershed Conservation and Development Commission to continue to manage the Newark watershed properties thus spending City of Newark resources, against the advice of the Municipal Council.

NOW THEREFORE BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT
