WHEREAS, the Municipal Council deems it in the best interest of the City of Newark to amend the existing residency requirements for the appointment of Special Law Enforcement Officers to now require that all such persons at the time of appointment shall be bona fide residents of the City of Newark and to grandfather those individuals that may not be residents of the City of Newark but who seek immediate reappointment; and

WHEREAS, the Municipal Council deems it in the best interest of the City of Newark, to henceforth from the date of the adoption of this ordinance to require a bona fide residence in the City of Newark for all persons, excluding those grandfathered by the terms of the ordinance, who shall be appointed as Special Law Enforcement Officers.

NOW, THEREFORE, BE IT ORDAINED, BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK,THAT:

Section 1. Title 2, Administration, Chapter 24, Personnel Practices and Policies of the Revised General Ordinances of the City of Newark, New Jersey (2000), as amended and supplemented, Section 1.4 is hereby amended to read:

Seventy-five (75%) percent of [A]ll Special Law Enforcement Officers who shall hereafter be so appointed, are hereby required as a condition of their appointment to have their place of abode in the City of Newark and to be bona fide residents therein. A bona fide resident, for the purpose of this Section, is a person having a permanent domicile within the City of Newark and one which has not been adopted with the intention of again taking up or claiming a previous residence acquired outside of the City limits.
