WHEREAS, the North Jersey Transportation Planning Authority, Inc. (NJTPA), One Newark Center, 17th Floor, Newark, New Jersey 07102 and New Jersey Institute of Technology (NJIT), provide grant funds for various transportation related projects; and
WHEREAS, the City of Newark, at its option, is desirous of performing the work for the FY2013 Sub-Regional Transportation Planning Program for the City of Newark, in accordance with a certain work program application submitted to NJTPA/NJIT; and
WHEREAS, NJTPA/NJIT notified the City of Newark, in a letter dated June 19, 2012 that it was authorized to proceed with the work program with an approved budget of $86,177.50 (which includes Federal Funding of $68,942.00 + Local In-Kind Match of $17,235.50) to be used for the FY2013 Sub-Regional Transportation Planning Program for the City of Newark, upon executing of a subcontract agreement; and
WHEREAS, in order to receive the grant award and proceed with the work plan, the City of Newark must execute a Subcontract for the FY 2013 Subregional Transportation Planning Program, with NJTPA/NJIT, acting as the Contractor .
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of Engineering, are hereby authorized to execute the Sub-Contract Agreement with North Jersey Transportation Planning Authority, Inc., (NJTPA), One Newark Center, 17th Floor, Newark, New Jersey 07102 (in conjunction with New Jersey Institute of Technology (NJIT) for the FY2013 Sub-Regional Transportation Planning Program for the City of Newark ( a copy of the application is attached hereto and made a part hereof).
2. The Municipal Council hereby ratifies its authorization of the work program application from the date of application submission to the date of adoption of this authorizing resolution.
3. The grant award in the amount of $68,942.00 from the North Jersey Transportation Planning Authority, Inc., is hereby accepted (a copy of the award letter dated June 19, 2012 is attached hereto and made a part thereof).
4. The Mayor and/or his designee, the Director of Engineering and/or his designee, are hereby authorized to enter into and execute any necessary grant documents with the North Jersey Transportation Planning Authority, Inc. (NJTPA), and New Jersey Institute of Technology (NJIT), to receive and expend the grant award in the amount of $68,942.00 + Local In--Kind Match of $17,235.50 for FY2013 Sub-Regional Transportation Planning Program for the City of Newark, for the period commencing on July 1, 2012 and terminating on June 30, 2013 (a copy of the Agreement is attached and made a part hereof).
5. The Sub-Contract between the City of Newark and North Jersey Transportation Planning Authority, Inc., /New Jersey Institute of Technology, is hereby ratified from July 1, 2012 to the date of adoption of this authorizing resolution.
6. Matching funds for this grant in the amount of $17,235.50 shall be in the form of In-Kind Services, provided by the personnel from the Division of Traffic and Signals, Department of Engineering, City of Newark.
7. The Director of the Department of Engineering and/or his designee, shall file a fully executed copy of the work application, the grant award letter, and the Sub-Contract in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the action taken by the Director of the Department of Engineering to submit a work program application for grant funding from the North Jersey Transportation Planning Authority, Inc. (NJTPA), and New Jersey Institute of Technology (NJIT), for the project "FY2013 Sub-Regional Transportation Planning Program for the City of Newark" and ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to enter into and execute a Sub-Contract to accept grant funds in the amount of $68,942.00 from North Jersey Transportation .Planning Authority, Inc.,/New Jersey Institute of Technology, for the period commencing July 1, 2012 and terminating on June 30, 2013. No municipal funds need to be expended for this agreement except In-Kind Services in the amount of $17,235.50 to be provided by City personnel.
