Body
WHEREAS, pursuant to Resolution 7R8-a, adopted on October 19, 2011, the Mayor and/or his designee, the Acting Deputy Director of Workforce Development, One Stop Career Center/NewarkWORKS, were authorized to accept grant funds in the amount of $259,500.00 from the New Jersey Department of Labor and Workforce Development in association with the Workforce Learning Link program; and
WHEREAS, pursuant to Resolution 7R1-q, adopted on December 21, 2011, a budget insertion was established for the above-described grant funds; and
WHEREAS, there exists a need for the City of Newark, One Stop Career Center-Newark Works ("NOSCC"), located at 990 Broad Street, Newark, New Jersey 07102, to enter into a contract with an entity that can provide educational services to ninety-five (95) Newark residents to assist them with learning basic educational skills including, but not limited to, learning to read, speak and write English as a second language ("ESL"); and
WHEREAS, this contract is being awarded as an exception to the public bidding requirements of the Local Public Contracts Law, because this contract is for the provision of educational services, as per N.J.S.A. 40A:11-5(1)(q); and
WHEREAS, the NOSCC concludes that La Casa de Don Pedro, 75 Park Avenue, Newark, New Jersey 07104 ("La Casa de Don Pedro"), has a history of providing said skills and educational training including, ESL and literacy training, and based upon their experience and abilities it is in the best interest of the City of Newark that an award be made to them in the amount not to exceed $95,000.00 to provide the above-referenced educational services, as more fully set forth in the contract attached hereto and made a part thereof, for a period from July 1, 2011 through June 30, 2012 with funds to be fully expended by December 31, 2012; and
WHEREAS, this contract is being awarded to a non-profit organization, and as such, is not governed by the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, or the City of Newark's Executive Order Number MEO-07-0001, which prohibit, and/or require the reporting of, certain political contributions.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Deputy Mayor/Director of Economic and Housing Development and the Acting Deputy Director of the Newark One-Stop Career Center-NewarkWORKS, are hereby authorized to enter into and execute a contract with La Casa de Don Pedro, 75 Park Avenue, Newark, New Jersey 07104, to provide educational services to ninety-five (95) Newark residents to assist them with learning basic educational skills including, but not limited to, learning to read, speak and write English as a second language, for the period of July 1, 2011, through June 30, 2012, with funds to be fully expended by December 31, 2012.
2. The contract between the City of Newark and La Casa de Don Pedro is hereby ratified from July 1, 2011 to the date of adoption of this authorizing resolution.
3. The total compensation to be paid pursuant to said contract is $95,000.00.
4. All compensation paid pursuant to said contract shall be paid from the grant funds received from the New Jersey Department of Labor and Workforce Development's Workforce Learning Link program.
5. Attached hereto is a certification of funds from the Municipal Comptroller of the City of Newark in the amount of $95,000.00 which states (1) that there are sufficient funds for the purpose set forth hereinabove and (2) that the line appropriation of the official budget which shall be charged is Account Number 72060, Business Unit NW051, Department G11, Project Number M11G0, Budget Reference B2011.
6. This contract is being awarded as a N.J.S.A. 40A:11-5(1)(q) exception to the public bidding requirements of the Local Public Contracts Law, in that the subject matter consists of the provision of educational services.
7. This contract is being awarded to a non-profit organization, and as such, is not governed by the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, or the City of Newark's Executive Order Number MEO-07-0001, which prohibit, and/or require the reporting of, certain political contributions.
8. The Acting Deputy Director of Workforce Development, Newark One Stop Career Center/Newark WORKS shall file a copy of this resolution and a fully executed copy of the contract authorized herein, in the Office of the City Clerk.
9. There shall be no amendment or changes to this contract without the approval of the Municipal Council of the City of Newark.
10. There shall be no advance payments made against this contract in accordance with N.J.S.A. 40A:5-16.
STATEMENT
This resolution ratifies and authorizes the Mayor and /or his designees, the Deputy Mayor/Director of Economic and Housing Development and the Acting Deputy Director of Newark One Stop Career Center-NewarkWORKS, to enter into and execute a contract with La Casa de Don Pedro, 75 Park Avenue, Newark, New Jersey 07104, for the purpose of providing educational services to ninety-five (95) residents of the City of Newark to assist them with learning basic educational skills including, but not limited to, learning to read, speak and write English as a second language for the period commencing on July 1, 2011 and terminating on June 30, 2012, in an amount not to exceed $95,000.00, with funds to be fully expended by December 31, 2012.
