      WHEREAS, the City of Newark applied for a One Million Dollar ($1,000,000.00) from the United States Environmental Protection Agency ("USEPA") Revolving Loan Fund Grant to, among other things, fund marketing and outreach, management, underwriting and loans/sub-grants relating to the cleanup of brownfield sites located within the City; and
      
      WHEREAS, as a result of the above application, the City was awarded the grant funds and pursuant to Resolution 7R3-h, authorized on February 3, 2010, accepted said grant funds and entered into a grant agreement with USEPA; and
 
WHEREAS, a portion of the USEPA Revolving Loan Fund ("RLF") Program provides for funding in the form of sub-grants that may be made available by the City to not-for-profit entities in support of conducting environmental cleanup activities at qualifying brownfield properties located within the City of Newark; and
 
WHEREAS, the Urban League of Essex County ("ULEC"), a not-for-profit entity, owns and manages a Child Development Center at a location identified on the City's official Tax Map as 494-504 Central Avenue, Block 1829, Lots 3 and 6; and
 
WHEREAS, the ULEC is required by the New Jersey Department of Environmental Protection ("NJDEP") to perform environmental cleanup activities at the property; and
 
WHEREAS, the USEPA has reviewed information regarding the ULEC's Child Development Center and has provided notification on July 27, 2012 that the site was approved for purposes of qualifying for the City's RLF Program; and
 
      WHEREAS, the City wishes to enter into an agreement to sub-grant USEPA RLF monies of up to One Hundred Nine Thousand Eight Hundred Twenty Seven Dollars ($109,827.00) to conduct eligible cleanup activities at the subject property in order to fulfill the NJDEP cleanup requirements.  
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:        
 
1.      The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a Sub-grant Agreement, in the form attached hereto, with the Urban League of Essex County ("ULEC"), 508 Central Avenue, Newark, New Jersey 07107for an amount of up to One Hundred Nine Thousand Eight Hundred Twenty Seven Dollars ($109,827.00), to permit ULEC to conduct eligible environmental cleanup activities at their Childhood Development Center located at 494-504 Central Avenue, Block 1829, Lots 3 and 6.
 
2.      The Deputy Mayor/Director of the Department of Economic and Housing Development shall file a copy of the fully executed Sub-grant Agreement with the ULEC with the Office of the City Clerk.  
 
3.      Attached herto is the certifications of funds from the Director of Finance of the City of Newark in the amount of $109,827.00 which states: 1) that there are sufficient funds for the purpose set forth hereinabove and 2) that the line appropriation of the official budget which shall be charged is: Account No. 72090, Business Unit NW051, Department  G10, Div./Proj. D10N0, Budget Ref. B2010.
 
4.      The contract  is for a twelve (12) month period beginning with the  date of execution of the Agreement.
 
 
5.      Upon execution of said agreement and filing thereof, the City shall be authorized to take all actions necessary to comply with the USEPA program, including but not limited to disbursement of sub-grant funds, overseeing the ULEC cleanup activities, and effectuating documents regarding same.  
 
6.      This resolution shall take effect immediately.
 
 
STATEMENT
 
Resolution authorizing the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute a Sub-grant Agreement with the Urban League of Essex County ("ULEC"), 508 Central Avenue, Newark, New Jersey 07107 for an amount of up to One Hundred Nine Thousand Eight Hundred Twenty Seven Dollars ($109,827.00) to permit ULEC to conduct eligible environmental cleanup activities at their Childhood Development Center located at 494-504 Central Avenue, Block 1829, Lots 3 and 6. (West Ward)  Sub-grant funds are to come from the City's existing United States Environmental Protection Agency Revolving Loan Fund Grant.
