WHEREAS, the New Jersey Department of Law & Public Safety, Division of Alcohol Beverage Control, as a sub-grantee of a block grant from the Office of Juvenile Justice and Delinquency Prevention, has made funding available to local jurisdictions to develop and further enhance programs that address underage drinking under a program entitled 2011 Enforcing the Underage Drinking Laws; and
 
WHEREAS, the City of Newark needs to undertake programs to address the public health issue concerning the consumption of alcohol by minors, and this grant award will fund police overtime initiatives, whereby undercover officers are placed in cooperating liquor establishments to prevent the illegal purchase of alcohol by underage persons; and
 
      WHEREAS, the City of Newark desires to further the public interest by obtaining funding from the New Jersey Division of Alcohol Beverage Control for police overtime initiatives, whereby undercover officers are placed in cooperating liquor establishments to prevent the illegal purchase of alcohol by underage persons; and
 
      WHEREAS, the Director of Police has prepared a full proposal and application to the New Jersey Division of Alcohol Beverage Control requesting grant funding in the amount of up to $16,640.00 from the 2011 Enforcing the Underage Drinking Laws for police overtime initiatives, whereby undercover officers are placed in cooperating liquor establishments to prevent the illegal purchase of alcohol by underage persons with no City funds required.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Mayor and/or his designee, the Director of Police, are hereby authorized to submit an application to the New Jersey Department of Law & Public Safety, Division of Alcohol Beverage Control requesting grant funding in the amount of $16,640.00 from the 2011 Enforcing the Underage Drinking Laws for police overtime initiatives, whereby undercover officers are placed in cooperating liquor establishments to prevent the illegal purchase of alcohol by underage persons with no City funds required (a copy of the application is attached hereto and made a part hereof).
    2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
    3. Upon notification of the receipt of a grant award in connection with this application, the grant is hereby accepted.
    1. Upon notification of the receipt of the 2011 Enforcing the Underage Drinking Laws grant award in connection with this application, the Mayor and/or his designee, the Police Director, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Law & Public Safety, Division of Alcohol Beverage Control to receive and expend the 2011 Enforcing the Underage Drinking Laws grant award for police overtime initiatives, whereby undercover officers are placed in cooperating liquor establishments to prevent the illegal purchase of alcohol by underage persons.
    1. Upon notification of the receipt of a grant award in connection with this application, the Police Director shall submit a complete copy of the 2011 Enforcing the Underage Drinking Laws grant agreement and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval, and signature.
    2. No municipal funds are required for receipt or acceptance of this grant award.
    3. The Police Director shall file a fully-executed copy of the grant application, the grant award letter, and the grant agreement with the Office of City Clerk.
 
 
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of Police to submit an application for, accept, and enter in a grant agreement for 2011 Enforcing the Underage Drinking Laws grant funding in the amount of $16,640.00 from the New Jersey Department of Law & Public Safety, Division of Alcohol Beverage Control for police overtime initiatives, whereby undercover officers are placed in cooperating liquor establishments to prevent the illegal purchase of alcohol by underage persons. No municipal funds are required.
