WHEREAS, the State of New Jersey Department of Environmental Protection Historic Preservation Office ("SHPO"), PO Box 420, Trenton, New Jersey 08625-0420, works to preserve, protect, and promote New Jersey's historic resources; and
 
WHEREAS, as part of its required review of construction plans for Newark Riverfront Park, located between Van Buren and Somme Streets and between Raymond Boulevard and the Passaic River, SHPO has required specific archaeological and historic interpretive work as part of the park construction; and
 
WHEREAS, without any application by the City of Newark, SHPO granted the City of Newark funds in the amount of $50,000.00 for archaeology and data recovery as part of the construction of the Newark Riverfront Park with no City funds required; and
 
WHEREAS, the City must execute a grant agreement with SHPO in order to obtain the grant award with no City funds required.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The grant award in the amount of $50,000.00 from the New Jersey Department of Environmental Protection Historic Preservation Office (SHPO) is hereby accepted (a copy of the grant award letter is attached hereto and made a part hereof).
 
2.      The Mayor and/or his designees, the Deputy Mayor/Director of the Department of Economic and Housing Development and the Business Administrator are hereby authorized to enter into and execute grant documents with SHPO in order to receive and expend the grant award in the amount of $50,000.00 for archaeology and data recovery as part of the construction of the Newark Riverfront Park located between Van Buren and Somme Streets and between Raymond Boulevard and the Passaic River, for the period commencing on June 1, 2011 or the effective date of the grant agreement, whichever is earlier and terminating thirty (30) months thereafter.
 
3.      The grant agreement between the City of Newark and SHPO is hereby ratified from June 1, 2011 or the effective date of the grant agreement, whichever is earlier to the date of adoption of this authorizing resolution.
 
4.      No municipal funds are required for receipt or acceptance of this grant award.
 
5.      A certified copy of this resolution will be forwarded to SHPO.
 
6.      The Deputy Mayor/Director of the Department of Economic and Housing Development shall file a fully-executed copy of the grant award letter and the grant agreement between the City of Newark and SHPO with the Office of the City Clerk.
 
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designees, the Deputy Mayor/Director of Economic and Housing Development  and the and the Business Administrator for actions taken to accept grant funds and to further enter into and execute a grant agreement with the New Jersey Department of Environmental Protection Historic Preservation Office for archaeology and data recovery as part of the construction of the Newark Riverfront Park, located between Van Buren and Somme Streets and between Raymond Boulevard and the Passaic River, for the period commencing on June 1, 2011 or the effective date of the grant agreement, whichever is earlier and terminating thirty (30) months thereafter, in the grant amount of $50,000.00.  No Municipal funds are required.
