AN ORDINANCE AMENDING SECTION 23:3-5, NO TURN ON RED, OF TITLE 23, TRAFFIC AND PARKING, OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED, BY PROHIBITING RIGHT TURNS ON RED AT THE INTERSECTION OF SUMMER AVENUE AND 3rd AVENUE.

WHEREAS, the Division of Traffic and Signals desires to improve safety at the signalized intersection of Summer Avenue and 3rd Avenue, in the North Ward, by prohibiting right turn on red at all approaches.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
Section 1. That Section 23:3-5, No Turn on Red, of Title 23, Traffic and Parking, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, be amended by adding thereto the following:
No person shall turn a vehicle to make a right turn when facing a steady red signal (STOP) indication at the following location, whenever an official sign is present prohibiting such a turn on the red signal:
Intersection Right Turn Prohibition
Summer Avenue and 3rd Avenue All right turns
Section 2. Any existing ordinances or parts thereof inconsistent with this Ordinance are hereby repealed.
Section 3. This Ordinance shall take effect upon final passage and publication and in accordance with the laws of the State of New Jersey.
Section 4. This Ordinance does not require approval by the Commissioner of Transportation.
STATEMENT
This ordinance prohibits vehicles from making a right turn when facing a steady red signal (STOP) indication at the intersection of Summer Avenue and 3rd Avenue in the North Ward, at all approaches, whenever an official sign is present prohibiting such a turn on the red.
