WHEREAS, the United States Department of Justice ("USDOJ") has made funds available through its Edward Byrne Memorial Discretionary Grants Program to assist, among other things, local jurisdictions with reducing the incidents of crime and enhance reentry services; and
 
WHEREAS, through Resolution 7R1-d, adopted October 19, 2011, the City of Newark Municipal Council ("Municipal Council") authorized the Mayor and/or his designee the Business Administrator, to prepare a proposal and application to the USDOJ for a grant award in the amount of $400,000.00 for Reentry Legal Services and Case Management and Job Placement Reentry Services; and
 
WHEREAS, the USDOJ awarded the City of Newark ("City") a $400,000.00 grant for these services and has approved a budget that includes expenditures of $300,000.00 for Reentry Legal Services and $100,000.00 for Case Management and Job Placement services, for the period of October 1, 2010 to September 30, 2011; and
 
WHEREAS, pursuant to Resolution 7R1-d 101911, the City accepted grant funds and entered into a grant agreement with the USDOJ, for the grant award 2010-DD-BX-0503, in the amount of $400,000.00, for the implementation of Reentry Legal Services and Case Management and Job Placement Reentry Services, for the period commencing on October 1, 2010 to September 30, 2011, and
 
WHEREAS, Resolution 7R1-d 101911 further authorized the Business Administrator to submit a Grant Adjustment Notice to the USDOJ requesting an extension of the above grant period to October 1, 2010 to September 30, 2012, that was previously approved by the USDOJ on June 24, 2011; and
 
WHEREAS, pursuant to Resolution 7R3-c(S) , adopted May 22, 2012, the Municipal Council authorized the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute an Extraordinary Unspecifiable Services Contract (the "VLJ Contract") with Volunteer Lawyers for Justice ("VLJ"), located at 101 Commerce Street, Newark, New Jersey, 07102, to provide Reentry Legal Services, in an amount not to exceed $300,000.00, for the period of January 15, 2012 to September 30, 2012 (the "Original Contract Term"); and
 
WHEREAS, pursuant to Resolution 7R3-k 090612, the Municipal Council authorized the Business Administrator to submit a Grant Adjustment Notice to the USDOJ requesting an extension of the above grant period  from October 1, 2010 through January 31, 2013, that was previously approved by the USDOJ on March 22, 2012; and
 
WHEREAS, the Business Administrator requested a third extension of the grant agreement to October 1, 2010 to December 31, 2013, through the submission of a Grant Adjustment Notice to USDOJ, which was approved by the USDOJ on August 3, 2012; and
 
WHEREAS, the City of Newark Department of Economic and Housing Development, through the Office of Reentry, seeks to amend the Original Contract Term with VLJ from January 15, 2012 through September 30, 2012 to January 15, 2012 through December 31, 2013, in accordance with the no-cost extension grant to the City by the USDOJ.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Business Administrator is hereby authorized to submit a Grant Adjustment Notice to the United States Department of Justice ("USDOJ") requesting an amendment to the above grant period from  October 1, 2010 to December 31, 2013.  The Municipal Council further ratifies the submission of this amendment request to the date of the adoption of this resolution.
 
2.      The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute any necessary documents with the USDOJ effectuating the amendment of the grant expiration date from January 31, 2013 to December 31, 2013. A copy of the USDOJ Grant Adjustment Notice approving the grant extension is attached.
 
3.      The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a First Amended Extraordinary Unspecifiable Services Contract, in the form attached hereto, with Volunteer Lawyers for Justice, located at 101 Commerce Street, Newark, New Jersey, 07102, which amends the term of the Contract from January 15, 2012 through September 30, 2012 to January 15, 2012 through December 31, 2013.
 
4.      No additional funds are required.  
 
5.      This resolution, a fully executed copy of the First Amended Extraordinary Unspecifiable Services Contract and the amended grant agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
 
6.      All other terms and conditions contained in the Extraordinary Unspecifiable Services Contract pursuant to Resolution 7R3-c(S) 052212 shall remain in full effect and in accordance with the law.
 
STATEMENT
 
This resolution ratifies and authorizes the Business Administrator to submit a Grant Adjustment Notice to the United States Department of Justice ("USDOJ") requesting an extension of the above grant period  from October 1, 2010 to December 31, 2013 and authorizes the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute any necessary documents with the USDOJ effectuating the extension of the grant agreement with the USDOJ. Further, this resolution authorizes the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute a First Amended Extraordinary Unspecifiable Services Contract, in the form attached hereto, with Volunteer Lawyers for Justice, located at 101 Commerce Street, Newark, New Jersey, 07102, which will extend the term of the Contract from January 15, 2012 through September 30, 2012 to January 15, 2012 through December 31, 2013.
