Whereas, through Resolution 7R1-d, adopted October 19, 2011, City of Newark Municipal Council ("Municipal Council") authorized the Mayor and/or his designee the Business Administrator to prepare a proposal and application to the United States Department of Justice ("USDOJ") for a grant award in the amount of $400,000.00 for Reentry Legal Services and Case Management and Job Placement Reentry Services; and
 
WHEREAS, the USDOJ awarded the City of Newark ("City") a $400,000.00 grant for these services and has approved a budget that includes expenditures of $300,000.00 for Reentry Legal Services and $100,000.00 for Case Management and Job Placement services, for the period of October 1, 2010 to September 30, 2011; and
 
WHEREAS, pursuant to Resolution 7R1-d 101911, the City accepted grant funds and entered into a grant agreement with the USDOJ, for the grant award 2010-DD-BX-0503, in the amount of $400,000.00, for the implementation of Reentry Legal Services and Case Management and Job Placement Reentry Services, for the period commencing on October 1, 2010 to September 30, 2011; and
 
WHEREAS, Resolution 7R1-d 101911 further authorized the Business Administrator to submit a Grant Adjustment Notice to USDOJ requesting an extension of the above grant period to October 1, 2010 to September 30, 2012, that was previously approved by USDOJ on June 24, 2011; and
 
WHEREAS, the term for the above grant agreement was subsequently amended twice through Resolution 7R1-d 101911 and through Resolution 7R3-k 090612 for the current term of October 1, 2010 to January 31, 2013; and
 
WHEREAS, the City of Newark, DEHD, through the Office of Reentry, is in need of Case Management and Job Placement Services; and
 
WHEREAS, pursuant to N.J.S.A. 40A:11-4.1(b)(2), a contract for such services may be awarded through a competitive contracting process; and
 
WHEREAS, the City of Newark issued a Request for Proposals on April 23, 2012, subject to the New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.4, to obtain proposals from vendors to provide the above Case Management and Job Placement Services; and
 
WHEREAS, seven (7) vendors submitted proposals (the "Proposals") in response to the City's RFP; and
 
WHEREAS, the Proposals were reviewed and evaluated by a six member Review Committee, comprised of five formerly incarcerated individuals; and
 
WHEREAS, the Urban League of Essex County, 508 Central Avenue, Newark, New Jersey, 07107, ("Urban League") submitted a proposal to serve forty (40) formerly incarcerated individuals and was selected by the Review Committee to provide Case Management and Job Placement Services due to its prior experience and proven ability as well as the quality of its proposal; and  
 
WHEREAS, the City desires to enter into a contract with Urban League in the amount of $100,000.00 for the purpose of providing Case Management and Job Placement Services to 40 formerly incarcerated individuals; and
 
WHEREAS, the contract is being awarded to a non-profit organization and as such is not governed by State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, or Newark Executive Order on Pay-to-Play Reform, MEO-07-0001; and
 
WHEREAS, the contract is funded solely through the grant award received from USDOJ through its Edward Byrne Memorial Discretionary Grants Program and no Municipal funds are required.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a Contract with the Urban League of Essex County, 508 Central Avenue, Newark, New Jersey, 07107, for the purpose of providing case management and job placement services to forty (40) formerly incarcerated individuals, in an amount not to exceed $100,000.00, for the period commencing on September 1, 2012 and terminating on January 31, 2013.
    2. The Contract between the City of Newark and the Urban League is hereby ratified from September 1, 2012 to the date of adoption of this authorizing resolution.
    3. Attached hereto is a certification of funds from the Municipal Comptroller of the City of Newark, which states that (1) there are available legally appropriated funds for the purpose set forth hereinabove in the amount of $100,000.00 and (2) that the line appropriation of the official budget which shall be charged is as follows:

    1. This contract is being awarded to the Urban League pursuant to the provisions of the State Local Public Contracts Law (N.J.S.A. 40A:11-1, et seq.). Since the Urban League is a non-profit organization, the procedures of the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, and Newark Executive Order MEO-07-0001, effective March 31, 2007, do not apply.
    1. A copy of the Comptroller's Certification and the fully executed contract herein authorized shall be filed in the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
    1. A notice of this action shall be published in the newspaper as required by law within ten (10) days of its passage.
 
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute a contract with the Urban League of Essex County, 508 Central Avenue, Newark, New Jersey, 07107 for the purpose of providing case management and job placement services to forty (40) formerly incarcerated individuals, in an amount not to exceed $100,000.00, for the period commencing on September 1, 2012 and terminating on January 31, 2013. This contract is being awarded to the Urban League pursuant to the provisions of the State Local Public Contracts Law (N.J.S.A. 40A:11-1, et seq.) and since the Urban League is a non-profit organization the State Pay to Play Law, N.J.S.A. 19:44A-20.5, and Newark Executive Order MEO-07-0001 do not apply.
