WHEREAS, the Essex County Executive's Office (Project Applicant), the Essex County Prosecutor's Office (Implementing Agency), the Newark Police Department (NPD), and the Essex County Family Justice Center, Inc (a Not-For-Profit Agency Serving Domestic Violence Victims) have come together to collaborate, enter into a Memorandum of Understanding and  make an application to the United States Department of Justice, Office on Violence Against Women (OVW) for the FFY 2011 Grants to Encourage Arrest Policies and Enforcement Protection Orders Program (A copy of the Memorandum of Understanding is a part of the Grant Application attached hereto); and
 
WHEREAS, the partners listed above have agreed to enter into a collaborative agreement which the Essex County Executive's Office will be the lead agency and the Essex County Prosecutor's Office will serve as the Implementing Agency and the named applicant and the other agencies will be partners in this application submitted on or about February 24, 2011; and
 
WHEREAS, on October 14, 2011, the Essex County Executive's Office (Project Applicant) was successfully awarded the Office on Violence Against Women (OVW) FFY 2011 Grants to Encourage Arrest Policies and Enforcement Protection Orders Program under GMS Award 2011-WE-AX-0042 and was accepted by the Essex County Board of Chosen Freeholders and inserted into the County Budget on May 2, 2012; and
 
WHEREAS, the objective of this Resolution is to ratify and authorize the grant application submitted to the United States Department of Justice Office on Violence Against Women by the County on February 24, 2011, thereby initiating and maintaining the grant-funded program meant to increase the efficiency and effectiveness of domestic violence procedures and policies within Essex County as a model for the entire State, and to satisfy all representations made therein; and
 
WHEREAS, on or about October 21, 2012, a Memorandum of Understanding among the participating partners was entered into setting forth the responsibilities of the parties; and
 
WHEREAS, the Newark Police Department will assign one of its sworn personnel to the Essex County Family Justice Center (ECFJC) located in Newark, New Jersey pursuant to the Memorandum of Understanding; and
 
WHEREAS, the approved grant budget in the amount of Two Hundred Seven Thousand Seven Hundred Three Dollars ($207,703.00) allows the Newark Police Department to hire one (1) police officer to include salary and fringe for a period of two years in conjunction with the parameters of the grant application; and
 
WHEREAS, the Essex County Freeholders approved Resolution# R-2012-00766 whereby grant funds, originating from the FFY 2011 Grants to Encourage Arrest Policies and Enforcement Protection Orders Program under GMS Award 2011-WE-AX-0042, would be allocated to the Newark Police Department for the purpose to hire one (1) police officer; and
 
WHEREAS, the County of Essex will provide the financial administration for the grant and will arrange for payment to the Newark Police Department of all NPD expenditures made for grant purposes that are approved on the grant budget and that are liquidated by the NPD and the City of Newark upon proper documentation; and
 
WHEREAS, all payments to the Newark Police Department will be paid by Essex County on a reimbursement basis; and
 
WHEREAS, the term of this Resolution shall be for the duration of the grant operational period and post-operational financial closing period, and beyond as necessary to fulfill all requirements of the grantor agency.  Additionally, this Memorandum of Understanding may be extended as set forth in the Duration and Modification provision of the Memorandum of Understanding and as set forth in all documents incorporated therein by reference.
 
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Police Director, are hereby authorized to enter into a Memorandum of Understanding with the Essex County Executive's Office (Project Applicant), the Essex County Prosecutor's Office (Implementing Agency), and the Essex County Family Justice Center, Inc (a Not-For-Profit Agency Serving Domestic Violence Victims) to collaborate, make an application for and participate in the Office on Violence Against Women (OVW) FFY 2011 Grants to Encourage Arrest Policies and Enforcement Protection Orders Program.
 
2.      The Municipal Council hereby ratifies its authorization of this application, along with the supporting and executed Memorandum of Understanding from the date of the application submission and execution of the supporting MOU to the date of adoption of this authorizing resolution.
 
3.      The Newark Police Department, as a sub-grantee shall abide by the parameters delineated in the United States Department of Justice application Memorandum of Understanding and the subsequent Memorandum of Understanding entered into with the County of Essex.
 
4.      The Newark Police Department will hire one (1) police officer in compliance with the award of the United States Department of Justice, Office on Violence Against Women (OVW) FFY 2011 Grants to Encourage Arrest Policies and Enforcement Protection Orders Program.
 
5.      The term of the Memorandum of Understanding with the County of Essex is for two years which may be extended pursuant to the terms of the grant and the Memorandum of Understandings.
 
6.      The t Memorandum of Understanding entered into with the County of Essex is ratified from  January 1, 2012, to the date of adoption of this authorizing resolution which was ratified and authorized by resolution of the Essex County Freeholders dated October 12, 2012.
 
7.      No municipal funds are required for receipt or acceptance of this sub-grant award.
 
 
 
STATEMENT
 
This resolution ratifies and authorizes the actions taken by the Police Director to enter into a collaborative effort involving the Essex County Executive's Office (Project Applicant), the Essex County Prosecutor's Office (Implementing Agency), and the Essex County Family Justice Center, Inc (a Not-For-Profit Agency Serving Domestic Violence Victims) to make an application for and participate in the Department of Justice, Office on Violence Against Women (OVW) FFY 2011 Grants to Encourage Arrest Policies and Enforcement Protection Orders Program, it further ratifies and authorizes the Police Director to execute a Memorandum of Understanding implementing the grant's purposes and hiring a police officer for two years in an amount not to exceed $207,730.00 both of which may be extended and renewed.  No municipal funds are required.
