              WHEREAS, the City of Newark, Department of Engineering has determined that Delancy Street between Avenue I and Rutherford Street is in need of major reconstruction, and through a federally funded Local Scoping process, has performed an alternative analysis to identify and evaluate viable feasible alternatives to reconstruct Delancy Street; and
 
            WHEREAS, the Department of Engineering's preferred alternative, referred to as Alternative 4 in the Delancy Street Local Scoping Project Alternative Analysis Report (a copy of the Delancy Street Local Scoping Project Alternative Analysis Report is attached hereto and made a part hereof), is a complete reconstruction of Delancy Street between Avenue I and Rutherford Street and requires right of way acquisition and easements; and
 
WHEREAS, the City of Newark requires funds for the right of way acquisition and easements for Delancy Street between Avenue I and Rutherford Street; and
 
            WHEREAS, on November 13, 2012, the City of Newark received a letter (a copy of the authorization letter is attached hereto and made a part hereof) from the advising that the Federal Highway Administration had authorized $1,900,000.00 for the right of way acquisition and easements required for Delancy Street between Avenue I and Rutherford Street, with no City funds required.
 
            WHEREAS, the Director of the Department of Engineering desires to apply and accept the grant award; and
 
            WHEREAS, the Director of Department of Engineering shall submit a copy of the grant agreement to the Corporation Counsel and the Business Administrator for review, approval, and signature.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to apply to the New Jersey Department of Transportation, requesting grant funding in the amount of $1,900,000.00 for the right-of-way acquisition and easements required for Delancy Street between Avenue I and Rutherford Street, with no City funds required.
    3. The grant award in the amount of $1,900,000.00 from the New Jersey Department of Transportation is hereby accepted (a copy of the authorization letter is attached hereto and made a part hereof).
    1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Transportation to receive and expend the grant award in the amount of $1,900,000.00 for the right-of-way acquisition and easements required for Delancy Street between Avenue I and Rutherford Street.
    1. No municipal funds are required for receipt or acceptance of this grant award.
    1. The Director of Department of Engineering shall file a fully-executed copy of the grant application, the grant award letter and the grant agreement in the Office of the City Clerk.
 
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to apply and accept grant funds in the amount of $1,900,000.00 from the New Jersey Department of Transportation, for the right-of-way acquisition and easements required for Delancy Street between Avenue I and Rutherford Street. No municipal funds are required for receipt or acceptance of this grant award.
