WHEREAS, the City of Newark, Department of Child and Family Well-Being desires to provide public health laboratory services to residents in the City of Newark; and
 
WHEREAS, the City of Newark desires to engage a contractor through competitive contracting to provide laboratory testing, in accordance with Local Public Contracts Law N.J.S.A. 40A:11-4.1e; and
 
 WHEREAS, on August 30, 2012, the Department of Child and Family Well-Being advertised a Request for Proposal for Public Health Laboratory Services, a copy of which is attached hereto, with a return date of September 14, 2012; and
 
WHEREAS, the Municipal Council hereby ratifies the use of Competitive Contracting for solicitation of this service from August 30, 2012, to the date of adoption; and  
 
WHEREAS, on September 14, 2012, the Department of Child and Family Well-Being received one (1) proposal which was opened on September 14, 2012, and entered on the tab bid sheet, a copy of which is attached; and
 
WHEREAS, Laboratory Corporation of America Holdings has represented that it is qualified by its training and experience to provide the required services in the manner and on the terms and conditions set forth in the proposed contract (a copy of which is attached); and
 
WHEREAS, the Proposal received from Laboratory Corporation of America Holdings was most advantageous to the City of Newark based on experience and on criteria as listed on the Request for Proposal; and
WHEREAS, this contract is awarded pursuant to the Fair and Open Process, as defined at N.J.S.A.19:44A-20.7, and is therefore in compliance with the "New Jersey Local Unit Pay-To-Play" law; and
 
WHEREAS, Laboratory Corporation of America Holdings has executed the City of Newark's Stockholders Disclosure Certificate and the City of Newark's Political Contribution Disclosure Form, copies of which  are attached hereto, and is and will remain otherwise complaint with the City of Newark's Executive Order MEO-07-0001; and
 
WHEREAS, this contract shall be awarded as an open-ended contract and shall not exceed $460,000.00.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Director of the Department of Child and Family Well-Being are hereby authorized to enter into and execute a contract with Laboratory Corporation of America Holdings, 69 First Avenue, Raritan, New Jersey 08869, for the provision of public health laboratory services in the City of Newark, for the period of January 1, 2013 through December 31, 2013, for an amount not to exceed $460,000.00.
 
2.      This contract for laboratory testing services is being awarded by a competitive contracting process in accordance with Law N.J.S.A. 40A:11-4.1e, and is therefore being awarded by a Fair and Open Process as defined at N.J.S.A.19:44A-20.7, and therefore this contract is being award in compliance with both New Jersey's "Local Public Contracts Law" and the "New Jersey Local Unit Pay-to-Play" law.
 
3.      The use of Competitive Contracting is hereby ratified from August 30, 2012 to the date of adoption of this Resolution and the Municipal Council authorizes its use in the future for this purpose.
 
4.      The contract is being entered into in accordance with the City of Newark's Executive Order MEO-07-0001, effective March 31, 2007.
 
5. The contract is further awarded as an open-ended contract pursuant to N.J.A.C.5:30-5.5(b)(2). Thus, for any all expenditures against this contract a Certification of Funds shall be executed each time services are used and charged against this contract.6. A notice of this action shall be published in the newspaper authjorized by law
to publish a legal advertisement and as required by law within ten (10) days of its
passage
 
7. A copy of the executed resolution and contract shall be filed in the Office of the
City Clerk by the Director of the Department of Child and Family Well-Being.
 
 
STATEMENT:
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Child and Family Well-Being, to enter into and execute an open-ended contract with Laboratory Corporation of America Holdings, 69 First Avenue, Raritan, New Jersey 08869, for the provision of Public Health Laboratory Services in the City of Newark, for the period of January 1, 2013 through December 31, 2013. The use of Competitive Contracting is ratified from August 30, 2012 to the date of adoption of this resolution. The contract amount shall not exceed $460,000.00. The contract is awarded pursuant to N.J.S.A. 40A:11-4.1e as Laboratory Testing Services, in compliance with a "Fair and Open" procedure of New Jersey Pay-to-Play Law, and is in compliance with Newark Executive Order MEO-07-0001.
