WHEREAS, the City of Newark desires to engage contractors to provide temporary staffing for professional personnel services, including but not limited to healthcare and social services. The professional personnel temporary staff will service the City of Newark, at locations 920 Broad Street, Newark, New Jersey, 110 William Street, Newark, New Jersey, 94 William Street, Newark, New Jersey, 394 University Avenue, Newark, New Jersey, including all other city agencies throughout the City of Newark, usage as described in the attached RFP proposal; and
 
WHEREAS, the City of Newark desires to provide said services for the period of one (1) year, with an option to renew for one (1) additional year; and
 
WHEREAS, on June 1, 2012, the Department of Child and Family Well-Being   advertised a Request for Proposal for Temporary Staffing for Professional Personnel Services, a copy of which is attached hereto, with a return date of June 14, 2012; and
 
WHEREAS, on June 14, 2012, the Department of Child and Family Well-Being received two (2) proposals which were opened on June 14, 2012, and entered on the bid tabulation sheet, a copy of which is attached; and
 
WHEREAS, Axion Healthcare Solutions, LLC, One Gateway Plaza, Suite 2600, Newark, New Jersey 07102 and Delta-T Group North Jersey, Inc., One Woodbridge Center, Suite 512, Woodbridge, New Jersey 07095, has represented that they are qualified by their training and experience to provide the required services in the manner and on the terms and conditions set forth in the proposed contract, a copy of which is attached; and
 
WHEREAS, the Proposals received from Axion Healthcare Solutions, LLC and Delta-T Group North Jersey, Inc., was determined to be most advantageous to the City of Newark based on experience and on criteria as listed on the Request for Proposal; and
 
WHEREAS, this contract is awarded pursuant to the Fair and Open Process, as defined at N.J.S.A.19:44A-20.7, and is therefore in compliance with "New Jersey Local Unit Pay-to-Play" law; and
 
WHEREAS Axion Healthcare Solutions, LLC, One Gateway Plaza , Suite 2600, Newark, New Jersey 07102  and Delta-T Group North Jersey, Inc., One Woodbridge Center, Suite 512, Woodbridge, New Jersey 07095,  has executed the City of Newark's Stockholder Disclosure and the City of Newark's Political Contribution Disclosure Form, copies of which are attached hereto, and is and will remain otherwise compliant with the City of Newark's Executive Order MEO-07-0001; and
 
      WHEREAS, this contract shall be awarded as an open-ended contract and shall not exceed $2,000,000.00.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Director of the Department of Child and Family Well-Being are hereby authorized to enter into and execute a contract with Axion Healthcare Solutions, LLC, 1 Gateway Plaza, 2600, Newark, NJ 07102 and Delta-T Group North Jersey, Inc., One Woodbridge Center, Suite 512, Woodbridge, NJ 07095, for the provision of temporary staffing for professional personnel services, including but not limited to healthcare and social services in the City of Newark, at locations 920 Broad Street, Newark, New Jersey, 110 William Street, Newark, New Jersey, 94 William Street, Newark, New Jersey, 394 University Avenue, Newark, New Jersey, including all other city agencies throughout the City of Newark, usage as described in the attached RFP proposal, for the period of one (1) year from the date of adoption, with an option to renew for one (1) additional year, for an amount not exceed $2,000,000.00.
 
2.      This contract is awarded pursuant to the Fair and Open Process N.J.S.A.19:44A-20.5, and as a competitive bidding contract pursuant to Local Public Contracts Law N.J.S.A. 40A:11-5(1), which provides that a contract of this type itself must be available for public inspections.
 
3.      The contract is in compliance with the city of Newark Executive Order MEO-07-0001, effective March 31, 2007.
 
4.      The contract is further awarded as an open-ended contract pursuant to N.J.A.C.  5:30-5.5(b) (2). A Certification of Funds shall be executed each time services are used and charged against this contract.
 
5.      A copy of the proposed Contract is attached hereto.
 
6.      A notice of this action shall be printed in a local newspaper as required by
law within ten (10) days hereof.        
      
      7.      .A duly executed copy of the aforesaid Contract shall be filed forthwith in      the  Office of the City Clerk by the Director of the Department of Child and Family Well-Being.
 
 
STATEMENT:
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Child and Family Well-Being, to enter into and execute an open-ended contract with Axion Healthcare Solutions, LLC, One Gateway Plaza, Suite 2600, Newark, New Jersey 07102 and Delta-T Group North Jersey, Inc., One Woodbridge Center, Woodbridge, New Jersey 07095,  for the provision of Temporary Staffing for Professional Personnel Services in the City of Newark, for the period of one (1) year from the date of adoption, with an option to renew for one (1) additional year. The contract amount shall not exceed $2,000,000.00. The contract is awarded in accordance with N.J.S.A. 40A:11-5(1) (a) (i) and is therefore being awarded by a Fair and Open Process as defined at N.J.S.A.19:44A-20.5, and therefore the contract are in compliance with both New Jersey's "Local Public Contracts Law" and the "New Jersey Local Unit Pay-to-Play "law, and is in compliance with Newark Executive Order MEO-07-0001, effective March 31, 2007.
