Whereas, pursuant to N.J.S.A. 40A:9-120 et seq., the City of Newark is authorized to appoint up to 50 Constables to establish the term for such appointment at one (1) or three (3) years; and
Whereas, the City of Newark wishes to implement the three (3) year option.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
David Otis Carter, 61-4th Street, Newark, New Jersey, be and he is hereby appointed Constable in accordance with his application to server subpoenas and warrants.
Prior to entering upon the execution of his office and no later than thirty (30) days after effective date of the appointment, the aforesaid appointee shall submit a Constable Bond, which shall be approved as to form, amount and sufficiency of Surety by Resolution of the Municipal Council.
This appointment shall be for a period of three (3) years from the date of the Constable Bond to its expiration, whichever occurs first.
STATEMENT
This resolution authorizes David Otis Carter, to serve as a Constable in the City of Newark, New Jersey for a period of three (3) years from the date of the Constable Bond to its expiration, whichever occurs first.
