WHEREAS, it is the desire of the City of Newark to provide a clean, litter free environment for its citizens; and
WHEREAS, the City of Newark is eligible to receive an annual grant under the Municipal Tonnage Act of the State of New Jersey, (N.J.S.A 13:1E-99.37 et seq., as amended by P.L. 1989, C. 108), and administered by the New Jersey Department of Environmental Protection; and
WHEREAS, said grant is to create or to supplement an existing Municipal Tonnage Program within the municipality; and
WHEREAS, to be eligible for this funding, the City of Newark must adopt a model program for tonnage control as required by N.J.S.A. 13:1E-99.37, and must certify that the model program has been adopted; and
WHEREAS, the State of New Jersey Department of Environmental Protection authorized the City of Newark's Department of Neighborhood and Recreational Services to closeout all balances in old existing Municipal Tonnage Grants and to rollover the balances to create a new Municipal Tonnage Grant in the amount of $820,354.35, with the new grant period running from August 1, 2012 through July 31, 2013 (see Closeout Municipal Budget attached hereto and made a part hereof).
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1.       The Mayor and/or his designee, the Director of the Department of Neighborhood and Recreational Services are hereby authorized to close out the old existing Municipal Tonnage Grants and re-appropriate the balances into one new Municipal Tonnage Grant to operate from August 1, 2012 through July 31, 2013 in the amount of $820,354.35.
 
2.      The Municipal Council of the City of Newark hereby ratifies the use of unobligated funds from prior budget periods and is allowing the Department of Neighborhood and Recreational Services to re-appropriate funds for a new Municipal Tonnage Grant from August 1, 2012 to the date of adoption of this authorizing resolution.
 
3.      The Department of Neighborhood and Recreational Services will be responsible for the Municipal Tonnage Grant implementation and the Director of Neighborhood and Recreational Services is hereby designated as the Municipal Tonnage Coordinator.
 
4.      An executed copy of this Resolution and Budget shall be filed in the Office of the City Clerk by the Director of the Department of Neighborhood and Recreational Services.
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Neighborhood and Recreational Services to close-out prior years' budgets and to rollover all available balances to create a new Municipal Tonnage Grant in the amount of $820,354.35.  The new grant will operate from August 1, 2012 through July 31, 2013.
