WHEREAS, City of Newark owns and operates a Rock Salt storage and dispensing facility for its own needs; and
WHEREAS, Newark Public School District is desirous of making use of the Rock Salt storage and dispensing facility owned by City of Newark located at 62 Frelinghuysen Avenue, Newark, New Jersey; and
WHEREAS, N.J.A.C. 5:34-7.15 authorizes contracting units to establish a Commodity Resale System, subject to an initial registration with, and approval by, the Director of the Division of Local Government Services in the New Jersey Department of Community Affairs ("Director"); and
WHEREAS, the City of Newark, located in the County of Essex, State of New Jersey, is desirous of establishing a Commodity Resale System for the resale of Sodium Chloride (Rock Salt-Bulk); and
WHEREAS, the City of Newark has agreed to serve as the Lead Agency for a Commodity Resale System with Newark Public Schools; and
WHEREAS, N.J.S.A 40A:11-10(b) authorizes a governing body of any contracting unit to enter in an agreement with the board of education of any school district for the provision of goods for use by their respective jurisdictions; and
WHEREAS, the City of Newark desires to enter into a commodity resale agreement with the Newark Public School District to provide Sodium Chloride (Rock Salt-Bulk); and
WHEREAS, the governing body of the Newark Public Schools considered and approved participation in a Commodity Resale System for the provision of Sodium Chloride.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Neighborhood and Recreational Services, are hereby authorized to establish the creation of a Commodity Resale System to be known as the Newark COMMODITY RESALE SYSTEM with the City of Newark serving as the Lead Agency, subject to initial registration with, and approval by, the Director of the Division of Local Government Services.
2. The Mayor and/or his designee, the Director of the Department of Neighborhood and Recreational Services, are hereby authorized to enter into a contract with the Newark Public School District for the sale of Sodium Chloride (Rock Salt-Bulk) at a price of $80.40 per ton which is the current pricing but may increase based on market rate, subject to the Commodity Resale System's initial registration with, and approval by, the Director of the Division of Local Government Services.
3. This authorization is hereby ratified from November 1, 2012 to the date of adoption of this authorizing resolution.
4. A single certified copy of this Resolution along with (1) a copy of the purchase agreement and (2) a copy of the Request for Registration of a Commodity Resale System Form (Cooperative Purchasing Form CP-2060) shall be forwarded to the Director of the Division of Local Government Services within the State Department of Community Affairs.
5. A fully-executed copy of the purchase agreement, a copy of the Request for Registration as filed, and a copy of the State Director's approval of the formation of the Commodity Resale System, shall be filed with the Office of the City Clerk by the Director of the Department of Neighborhood and Recreational Services.
STATEMENT
This resolution authorizes the Mayor and/or his designee, the Director of the Department of Neighborhood and Recreational Services, to establish a commodity resale system with the City of Newark serving as the Lead Agency for the resale of Sodium Chloride (Rock Salt/Bulk).The Mayor and/or his designee, the Director of the Department of Neighborhood and Recreational Services, are authorized to enter into a contract with the Newark Public School District for the sale of Sodium Chloride (Rock Salt-Bulk) at a price of $80.40 per ton which is the current pricing but may increase based on market rate, for the period commencing on November 1, 2012 and terminating on March 31, 2014.
