WHEREAS, Resolution No. 7R4-A, adopted July 7, 2011, authorized the Director of the Department of Engineering to accept the bid proposal and execute Contract No. 16-2010R, Construction of UTCS Extension, Traffic Signal System Centralization, Section 4, with Daidone Electric, Inc., 200 Raymond Boulevard,, Newark, New Jersey 07105,, for the amount of $1,615,000.00; and
 
WHEREAS, on November 21, 2011, the Director of the Department of Engineering issued a formal Notice to Proceed, with December 14, 2011 as the contract commencement date; and
 
WHEREAS, the contract work has not yet been completed, necessitating an amendment of the term to include an amended termination date of September 1, 2013; and
 
WHEREAS, at the request of the Department of Engineering, the contractor has proposed contract deductions (offsets) of original contract quantities and costs, totaling $194,996.69,, certain different signal equipment and other  additional work, required by field adjustments and other revisions to the traffic signal network totaling $194,996.69, which on the whole do not substantially change the scope of work; and
 
WHEREAS, the attached Change Order No. 1 to Contract No. 16-2010R, Construction of UTCS Extension, Traffic Signal System Centralization, Section 4, does not increase the original contract amount of $1,615,000.00; and
 
WHEREAS, the attached Change Order No. 1 to Contract No. 16-2010R, Construction of UTCS Extension, Traffic Signal System Centralization, Section 4, also extends the term of the contract to complete actual construction to September 1, 2013.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee and the Director of the Department of Engineering is hereby authorized on behalf of the City of Newark to issue Change Order No. 1 to Contract No. 16-2010R, Construction of UTCS Extension, Traffic Signal System Centralization, Section 4.
 
2.      A fully executed copy of Change Order No. 1 to Contract No. 16-2010R, shall be filed in the Office of the City Clerk by the Director of Engineering.
3.      Municipal Council ratifies the contract term extension from December 13, 2012 to the date of adoption of this resolution.
 
4.      No other changes to this contract are allowed without prior Municipal Council approval.
 
5.      Consistent with the provisions of the Local Public Contracts Law, N.J.S.A. 40A:11-15(9), the Director of the Department of Engineering is authorized to extend the term of the contract in order to complete actual construction to September 1, 2013.
 
6.      The term of this contract is amended from a commencement date of December 14, 2011 and terminating on December 13, 2012, to December 14, 2011 and terminating on September 1, 2013.
 
 
STATEMENT
 
This Resolution authorizes and ratifies the Mayor and/or his designee and the Director of the Department of Engineering to issue Change Order No. 1 to Contract No. 16-2010R, Construction of UTCS Extension, Traffic Signal System Centralization, Section 4, extending the term of the contract to complete actual construction to September 1, 2013.
