WHEREAS, pursuant to Resolution 7R1-a, adopted on March 16, 2011, the Municipal Council of the City of Newark authorized the Mayor and the Business Administrator to enter into an agreement to redistribute unexpended ESG grant funds in the amount of $301,539.42 from the United States Department of Housing and Urban Development's (HUD) Emergency Shelter Grant (ESG) program; and
WHEREAS, pursuant to Resolution 7R1-H, adopted December 21, 2011, the Municipal Council of the City of Newark authorized the Mayor and the Business Administrator to enter into an Agreement with YMWCA of Newark & Vicinity, 600 Broad Street, Newark, New Jersey, 07102, for the provision of homeless prevention and renovation services for the period commencing on January 1, 2011 and terminating on December 31, 2011, for an amount not to exceed $49,230.83 and to be paid out by reprogrammed ESG funds; and
WHEREAS, due to the importance of the services and programs funded in whole or in part by ESG funds awarded to the City of Newark and performed or operated by local sub-recipients for the benefit of the public, as well as the importance of utilizing HUD funding in a timely manner, the Mayor and Business Administrator believe it is in the best interest of the City of Newark and Public who benefit from the services and programs, to extend the contract agreement between with YMWCA of Newark & Vicinity and the City of Newark for an additional year; and
WHEREAS, the Mayor and/or his designee, the Business Administrator desire to amend the terms of the existing agreement between the City of Newark and the Sub-recipient by extending the contract term through December 31, 2012, so that the Sub-recipient may provide further services of the same nature and type, and with no additional funding or cost to the City.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Business Administrator, are hereby authorized to enter into and execute an Amended Agreement as of January 1, 2011, on behalf of the City of Newark with YMWCA of Newark & Vicinity, 600 Broad Street, Newark, New Jersey, 07102, for the provision of homeless prevention and renovation services, which are further described in the "Scope of Services" attached herewith, for the amended agreement term which commenced on January 1, 2011 and will now terminate on December 31, 2012, with no additional funding or cost to the City.
2. The Amended Agreement between the City of Newark and the Sub-recipient is hereby ratified from January 1, 2011 to the date of adoption of this authorizing resolution.
3. A fully executed copy of said Amended Agreement shall be filed with the Office of the City Clerk by the Business Administrator.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Business Administrator to enter into an Amended Agreement with YMWCA of Newark & Vicinity, 600 Broad Street, Newark, New Jersey, 07102, to provide homeless prevention and renovation services for the amended agreement term of January 1, 2011 through December 31, 2012, with no additional funding or cost to the City.
