WHEREAS, the City of Newark on behalf of the Municipal Council advertised an RFQ for Statutory Auditor services pursuant to N.J.S.A. 40A:5-4 for Year ending December 31, 2012 and related accounting and auditing services for the Municipal Council; and
WHEREAS, accounting and auditing services are professional services, exempt from public bidding in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, only one response was received from Samuel Klein and Company, 550 Broad Street, Newark, New Jersey, 07102; and
WHEREAS, by Resolution 7 R9A, adopted on March 7, 2012, the Municipal Council awarded a contract to Samuel Klein and Company in the amount of $730,250.00; and
WHEREAS, the New Jersey Department of Community Affair’s requested that that the contract be amended to include only the fees for services relating to the 2012 Budget process in the amount of $150,000.00 and, services relating to a bond and note sale, , , in the amount of $60,500.00, respectively, for a total contract amount of $210,500.00; and
