WHEREAS, pursuant to Resolution 7R1-F, adopted on October 5, 2011, the Municipal Council of the City of Newark authorized the Mayor and the Business Administrator to enter into an agreement to receive and expend Community Development Block Grant (CDBG) funds from the United States Department of Housing and Urban Development (HUD) in the amount of $7,835,598.00; and
WHEREAS, after competitive contracting and fair open processes, and pursuant to Resolution 7R1-K, adopted August 1, 2012, the Mayor and/or his designee, the Business Administrator, were authorized to enter into an agreement with Jewish Renaissance Medical Center, Inc., 275 Hobart Street, Perth Amboy, New Jersey 08861 (hereinafter the "Sub-recipient"), awarding the sub-recipient a CDBG grant from CDBG funds in an amount not to exceed $20,500.00, to be used by the sub-recipient to provide Health Services, for the period commencing on January 1, 2012, and terminating on December 31, 2012; and
WHEREAS, the Sub-recipient provided the contracted Health Services in an effective and efficient manner; and
WHEREAS, due to the importance of the services and programs funded in whole or in part by CDBG funds awarded to the City of Newark and performed or operated by local sub-recipients for the benefit of the public, as well as the importance of utilizing HUD funding in a timely manner, the Mayor and Business Administrator, believe it is in the best interest of the City of Newark and the public ,who benefit from the services and programs, to extend the contract agreement between Jewish Renaissance Medical Center, Inc. and the City of Newark, an additional year; and
WHEREAS, the Mayor and/or his designee, the Business Administrator, desire to amend the terms of the existing agreement between the City of Newark and the Sub-recipient by extending the contract term through December 31, 2013, so that the Sub-recipient may provide further services of the same nature and type, at no additional cost to the City of Newark; and
WHEREAS, this agreement is being amended in compliance with Community Development Block Grant Regulations, 24 CFR.570.201.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Business Administrator, are hereby authorized to enter into and execute an Amended Agreement on behalf of the City of Newark with Jewish Renaissance Medical Center, Inc., 275 Hobart Street, Perth Amboy, New Jersey 08861, to provide Health Services, which are further described in the "Scope of Services" attached hereto and made a part hereof, for the amended agreement term of January 1, 2012, through December 31, 2013, at no additional cost to the City of Newark.
2. The Amended Agreement between the City of Newark and the Sub-recipient is hereby ratified from January 1, 2013 to the date of adoption of this authorizing resolution, with no additional funding.
3. All other terms and conditions of the original agreement with Sub-recipient shall remain unchanged and in full force and effect.
4. This contract is being awarded pursuant to the Community Development Block Grant Regulations, 24 CFR.570.201 regulations, and is in compliance State Pay-to-Play Law, N.J.S.A. 19:44A-20.5 and Newark Executive Order ME0-02-0001, effective March 31, 2007.
5. A fully-executed copy of said Amended Agreement shall be filed with the Office of the City Clerk by the Business Administrator.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Business Administrator, to enter into an Amended Agreement with Jewish Renaissance Medical Center, Inc., 275 Hobart Street, Perth Amboy, New Jersey 08861, to provide Health Services for the amended agreement term of January 1, 2012, through December 31, 2013, at no additional cost to the City of Newark.
