WHEREAS, the Department of Engineering is in need of professional engineering/architectural services for the Design and Preparation of Bid Documents and Construction Management Services for the 110 William Street Dental Office Project: and
WHEREAS, the contracted services to be provided must be performed by engineers/architects licensed by the State of New Jersey, which are professional services and are exempt from the public bidding requirements of the Local Public Contracts Law, pursuant to N.J.S.A. 40A:11-5 (1)(a)(i); and
WHEREAS, on June 18, 2012, the Department of Engineering, City of Newark, advertised for responses to a Request for Proposals for Contract #07-2012PS, "Design and Preparation of Bid Documents and Construction Management Services for 110 William Street Dental Office, Newark, New Jersey 07102", pursuant to the Local Public Contracts Laws, N.J.S.A. 40A:11-1 et seq.; and
WHEREAS, on July 17, 2012, the advertised, scheduled date for the public opening of the cost proposals, eleven (11) proposals were received; and
WHEREAS, based upon a review of the proposals, the Director of the Department of Engineering, has determined that the cost proposal received from CCMS Corporation, 1670 Route 34 North,,.Wall, New Jersey 07727, was the most advantageous to the City of Newark, cost and other factors considered and recommends that the Municipal Council award Contract #07-2012PS, "Design and Preparation of Bid Documents and Construction Management Services for 110 William Street Dental Office, Newark, New Jersey 07102," for the total not to exceed amount of $19,250.00 (Design and Preparation of Bid Documents: $11,000.00 and Construction Management Services: $ 8,250.00 ); and
WHEREAS, the Request for Proposal process constitutes a fair and open process in accordance with State of New Jersey Pay-to-Play Law, N.J.S.A. 19:44-20.5; and
WHEREAS, the Mayor of the City of Newark signed into law Executive Order #MEO-07-0001, which requires reporting of political contributions to Newark Municipal Candidates, and prohibits certain political contributions during the duration of the contract; and
WHEREAS, CCMS Corporation, 1670 Route 34 North, Wall, New Jersey 07727, has completed and submitted a City Political Contribution Disclosure Form, which certifies that the Business Entity has not made any reportable contributions to a political or candidate committee in the City of Newark in the previous one year, and the contract will prohibit the Business Entity from making any reportable contributions though the term of the contract.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee the Director of the Department of Engineering is hereby authorized to enter into and execute a Professional Services Contract #07-2012PS, "Design and Preparation of Bid Documents and Construction Management Services for 110 William Street Dental Office, Newark, New Jersey", with CCMS Corporation, 1670 Route 34 N, Wall, New Jersey 07727, for a total amount not to exceed $19,250.00 (Design and Preparation of Bid Documents: $11,000 and Construction Management Services: $8,250.00 ).
2. Attached hereto is a certification of funds issued by the Chief Financial Officer, City of Newark, which states that there are available sufficient legally appropriated funds in the amount of $19,250.00 for the purpose set forth hereinabove. Copies of the certification of funds shall be filed in the Office of the City Clerk by the Director of the Department of Engineering together with this resolution.
3. The term of this contract shall be one (1) year from the date a formal "Notice to Proceed" is issued by the Director of Engineering or his designee.
4. No amendments or modifications to this contract shall be allowed or authorized without prior Municipal Council approval.
5. A notice of this action shall be published in the newspaper as required by law within ten (10) days of its passage.
6. There shall be no advance payments made against this contract in accordance with N.J.A.C. 40A:5-16.
7. A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Director of Engineering or his designee.
8. The request for proposal process pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq. complies with the award requirements under the 'Fair and Open' process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq. and is in compliance with the City of Newark Executive Order and Pay-to-Play (MEO-07-0001).
9. CCMSCorporation, has completed and submitted a City Political Disclosure Form which states that the Business Entity has not made any reportable contributions to a political or candidate committee in the City of Newark in the previous one year, and the contract shall prohibit the Business Entity from making any reportable contributions through the term of the contract.
10. By executing this contract, the Business Entity (CCMS Corporation), certifies that it has neither made nor will make a prohibited contribution in violation of any applicable federal or state laws, or City Ordinances, including but not limited to the Executive Order on Pay-to-Play Reform (MEO-07-0001) as may be amended from time to time. Any such failure shall constitute a breach of the Contract.
11. Funds for this contract in the amount of $19,250.00,are provided from Fund: NW051, Department: G12, Project: 2H2K0, Account: 71280, Budget Year: B2012.

Wall, New Jersey 07727, for the total amount not to exceed $19, 250.00.
