WHEREAS, the Department of Neighborhood and Recreational Services, requests an extension of the emergency contract with D & J Marangi, Inc. t/a ACE Environmental Services, 429 Frelinghuysen Avenue, Newark, New Jersey 07114, to continue providing solid waste removal services; type 10, household garbage and type 13 bulk waste collection; and
WHEREAS, the areas of collection will include the southern side of 15th Avenue and Court Street to the City line of Hillside, New Jersey and the western side of Broad Street to the City line of Irvington, New Jersey; and
WHEREAS, it is imperative that we remove household garbage and bulk waste because not to do so will promote unsanitary living conditions, unhealthy air; affecting the health, safety and welfare of the citizens of Newark; and
WHEREAS, the cost for solid waste removal service is $156,598.00 monthly totaling $469,794.00 for three (3) months; and
WHEREAS, pursuant to N.J.A.C 5:34-6.1(a), notwithstanding a good faith effort by the contracting unit to award a contract, the need has arisen for an emergency contract for solid waste removal, types 10 and 13; and
WHEREAS, City Ordinance 6PSF-e 040611, Article 2:5-13.2(E)(1) (b), (c), states that Emergency Contracts shall not be for a period in excess of ninety (90) days and no extensions of emergency contracts shall be permitted without authorization by the Municipal Council by resolution; and
WHEREAS, through Resolution 7R1-d (s) dated June 26, 2012 ($500,000.00) and 7R1-p dated December 19, 2012 ($469,794.00) the Municipal Council authorized the Business Administrator and the Director of Neighborhood and Recreational Services to extend Contract # E2012-07 for ninety (90) day intervals, each.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Business Administrator and/or his designee, the Director of Neighborhood and Recreational Services are hereby authorized to execute an extension of Emergency Contract E2012-07 with D & J Marangi, Inc., t/a ACE Environmental Services, 429 Frelinghuysen Avenue, Newark, New Jersey 07114, to provide solid waste removal services of type 10, household garbage and type 13, bulk waste collection. The area of collection will include the southern side of 15th Avenue and Court Street to the City line of Hillside, New Jersey and the western side of Broad Street to the City line of Irvington, New Jersey, at a cost not to exceed $469,794.00 for ninety (90) day intervals.
2. This extension will allow the continuation of contract E2012-07, which commenced on April 2, 2012 through July 1, 2012.
3. Upon authorization and ratification the term of this extension will be April 1, 2013, to June 30, 2013; or, until a new contract is in place (whichever comes first).
4. Attached hereto, is budget details which states that there are sufficient funds for the purpose set forth hereinabove, NW011, Department 160, Division 1604, Account 71940 and fiscal year B2013.
5. A copy of said contract shall be filed with the Office of the City Clerk by the Business Administrator for the City of Newark.
STATEMENT
This Resolution ratifies and authorizes the Business Administrator and/or his designee the Director of Neighborhood and Recreational Services to extend for three (3) months from April 1, 2013 through June 30, 2013; or, until such time as a new contract is awarded (whichever comes first) the emergency contract with D & J Marangi, Inc., t/a ACE Environmental Services, to provide solid waste removal services for type 10, household garbage and type 13, bulk waste collection, in the amount not to exceed $469,794.00 per ninety (90) day interval.
