WHEREAS, the City of Newark has a need to provide Animal Shelter Management Services for its injured, trapped and sick animals and animals whose lives are endangered or animals that are a danger to human beings; and
WHEREAS, the City of Newark desires to provide animal control services in order to protect the health, safety and welfare of the citizens of the City of Newark; and
WHEREAS, N.J.S.A. 40:48-5.1 authorizes any municipality not having a public animal pound to award negotiated contracts for animal control services without public bidding, with a non-profit humane society situated in the County or any adjoining County to provide said services; and
WHEREAS, the City of Newark Department of Child and Family Well-Being, entered into a contract with Associated Humane Societies, pursuant to Resolution 7R2-n(AS) 090612, to provide animal control services in the City of Newark, for the period February 1, 2012 through January 31, 2013, with an option to renew for two (2) additional one (1) year contracts for 2014 and 2015; and
WHEREAS, the contract is an open-ended contract not to exceed $631,926.00 per year; and
WHEREAS, the City of Newark desires to exercise the option to renew the contract for the two (2) additional years for the periods of February 1, 2013 through January 31, 2014 and February 1, 2014 through January 31, 2015, in an amount not to exceed $631,926.00 per year; and
WHEREAS, pursuant to N.J.S.A. 40:48-5.1, a request for proposal is not required, the City has concluded it is in the best interest of the City to exercise its option to renew the contract with Associated Humane Societies, Inc., for both years and amend the contract accordingly each year; and
WHEREAS, pursuant to N.J.A.C.5:30-5.5(c), this contract is subject to the availability and appropriation of sufficient funds annually.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Child and Family Well-Being is hereby authorized to exercise its option to renew for two (2) additional one year periods and execute a contract with Associated Humane Societies, Inc., 124 Evergreen Avenue, Newark, New Jersey 07114, for the contract periods of February 1, 2013 through January 31, 2014 and February 1, 2014 through January 31,2015, in an amount not to exceed $631,926.00 per year, for provision of animal control services in the City of Newark.
2. The contract is awarded without competitive bidding as an exception to the Local Public Contracts Law in that the contract is between the City of Newark and Associated Humane Societies, Inc., 124 Evergreen Avenue, Newark, New Jersey 07114, and pursuant to N.J.SA. 40:48-5.1 and is in compliance with Executive Order MEO-07-0001, effective March 31, 2007.
3. Attached hereto is a partial Certification of Funds from the Comptroller for the City of Newark in the amount $165,881.00, which states; (1) that there are sufficient funds for the purpose set forth hereinabove and (2) that the appropriation of the official budget which shall be charged is Business Unit 011; Dept. ID 120; Division 1203; Account 9592, Expenditures of funds beyond the certified amount is contingent upon receipt of additional funds and filing of an additional certification of funds by the Director of Child and Family Well-Being with the Office of the City Clerk.
4. Pursuant to N.J.A.C.5:30-5.5(c), this contract is subject to the availability and appropriations of sufficient funds annually.
5. Pursuant to N.J.S.A. 27:25-17, any and all debts, expenses or obligations incurred by the Department of Child and Family Well Being shall be payable only from funds available to the City of Newark, and no liability or obligation shall be incurred by the Department of Child and Family Well-Being beyond the extent to which monies are available.
6. A notice of this action shall be published in a local newspaper as required by law within ten (10) days of its passage.
7. A copy of the proposed Contract is attached hereto.
8. A copy of the executed contract shall be filed in the Office of the City Clerk by the Director of the Department of Child and Family Well-Being.
STATEMENT
This legislation ratifies and authorizes the Mayor and/or his designee, the Director of Child and Family Well-Being, to exercise its option to renew for two (2) additional one year contracts and execute a contract without competitive bidding pursuant to N.J.S.A.40:48-5.1 with the Associated Humane Societies, Inc., 124 Evergreen Avenue, Newark, New Jersey 07114, for the contract period of February 1, 2013 through January 31, 2015, in the amount of $631,926.00 per year, for the provision of animal control services in the City of Newark.
