       WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $68,942.00 for the FY2013 Subregional Transportation Planning Grant (STP) and no adequate provision has been made in the 2013 Temporary Budget for the aforesaid purpose; and N.J. 40A:4-20 provides for the creation of an emergency appropriation for the purpose of aforementioned; and
 
      WHEREAS, by Resolution  7R4-d dated December 5, 2012, the City of Newark accepted the Subregional Transportation Planning Grant in the amount of $68,942.00 to enter into and execute any necessary documents with the North Jersey Transportation Planning Authority (NJTPA) to receive and expend the grant award and In-Kind Match of $17,235.50 for FY2013 Subregional Transportation Planning Program for the period commencing on July 1, 2012 and terminating June 30, 2013; and  
 
WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
 
      WHEREAS, emergency appropriation adopted in 2013 pursuant to N.J.S.A. 40A:4-20 including this resolution total...$70,194,351.66.
 
      NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
      1.  An emergency appropriation be and the same is hereby made for the following classification:

2.      Said emergency appropriation shall be provided for in the 2013 budget.
 
3.      A copy of this resolution shall be immediately filed with the Director of Local Government Services by the City Clerk of the City of Newark.
 
STATEMENT
 
This resolution establishes the appropriation in the amount of $68,942.00 for the FY2013 Subregional Transportation Planning Grant (STP).  No Municipal funds need to be expended for this agreement except In-Kind Match in the amount of $17, 235.50 to be provided by City personnel. The Contract period is from July 1, 2012 to June 30, 2013. Funding has been provided by the North Jersey Transportation Authority (NJTPA) (All Wards).
