WHEREAS, the City of Newark's, Department of Engineering, Division of Traffic and Signals, advertised in a local newspaper circulating within the municipality for the receipt of bids on April 26, 2012, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq., for Contract No. 08-2010, Wilson Avenue Reconstruction Eastern Phase Project; and
 
           WHEREAS, on June 14, 2012, the Department of Engineering, Division of Traffic and Signals, advertised Addendum No. 2 for the receipt of bids on June 26, 2012, for Contract No. 08-2010, Wilson Avenue Reconstruction Eastern Phase Project; and
 
WHEREAS, on June 26, 2012, eleven (11) bids were received for Contract No. 08-2010, Wilson Avenue Reconstruction Eastern Phase Project.; and
 
      WHEREAS, based on a review of the bids, the Director of the Department of Engineering, desires to accept the bid proposal submitted by the lowest responsible bidder, Underground Utilities Corp., 711 Commerce Road, Linden, New Jersey 07036, and execute Contract No. 08-2010, Wilson Avenue Reconstruction Eastern Phase Project for the Basic Bid with Alternate B, in an amount not to exceed $2,747,825.80.
 
 
      
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
  1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to accept the bid proposal submitted by the lowest responsible bidder, Underground Utilities Corp., 711 Commerce Road, Linden, New Jersey 07036, and execute Contract No. 08-2010, Wilson Avenue Reconstruction Eastern Phase Project, for the Basic Bid with Alternate B, in the amount not to exceed $2,747,825.80.
  2. Attached hereto are the Certification of Funds issued by the Chief Financial Officer, which states that there are available sufficient legally appropriated funds for the purpose set forth hereinabove within: Fund 051, Dept. G00, Project E10A0, Account 71930, Budget Year B2001 in the amount of $2,643,450.00 and within Fund 045, Dept. 007, Project 07B10, Account 94710, Budget Year B2007 in the amount of $104,375.80 for a total amount of $2,747,825.80.  Copies of the Certification of Funds issued shall be filed in the Office of the City Clerk by the Director of the Department of Engineering together with this resolution
  3. The term of this contract is three hundred sixty-five (365) consecutive calendar days from the date of issuance of a formal Notice to Proceed by the Director of the Department of Engineering.
  4. There shall be no amendments or changes of this contract without approval of the Municipal Council.
  5. A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
  6. The public bidding process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et. seq., complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq.
  7. The City Clerk shall file a Notice with the State Comptroller, on the prescribed form, of the award of this contract, as the contract amount exceeds $2 million, but is less than $10 million, in accordance with N.J.S.A. 52:15C-10.
 
 
 
 
STATEMENT
 
This resolution authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to accept the bid proposal submitted by the lowest responsible bidder, Underground Utilities Corp., 711 Commerce Road, Linden, New Jersey 07036, enter into and execute Contract No. 08-2010, Wilson Avenue Reconstruction Eastern Phase Project, for the Basic Bid with Alternate B, within three hundred sixty-five (365) consecutive calendar days from the date of issuance of a formal "Notice to Proceed" in an amount not to exceed $2,747,825.80.
