WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $207,730.00 for the 2011 Grants to Encourage Arrest Policies and Enforcement Protection Orders Program Grant and no adequate provision has been made in the 2013 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A: 4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
 
WHEREAS, by Resolution 7R11-b(AS) dated December 19, 2012, the City of Newark accepted the 2011 Grants to Encourage Arrest Policies and Enforcement Protection Orders Program Grant in the amount of $207,730.00 to fund the hiring of one (1) Police Officer; and
 
WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
 
WHEREAS, emergency appropriation adopted in 2013 pursuant to N.J.S.A. 40A:4-20, including this resolution total..$70,125,409.66.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1.      A temporary emergency appropriation is hereby made for the following classification:
      
 Program  2011 Grants to Encourage Arrest Policies and Enforcement Protection Orders Grant Program
 Amount  $207,730.00
2.      Said emergency appropriation shall be provided for in the 2013 budget.
 
3.      A copy of this resolution shall be immediately filed with the Office of the City Clerk by the Budget Director of the City of Newark.
 
      
STATEMENT
 
      This resolution authorizes and establishes the Appropriation for 2011 Grants to Encourage Arrest Policies and Enforcement Protection Orders Program Grant in the amount of $207,730.00 from the United States Department of Justice (USDOJ), Office on Violence Against Women.  The grant period is from September 1, 2011 through August 31, 2013 and may be extended as set forth in the Memorandum of Understanding and grant application.
