             WHEREAS, the State of New Jersey Department of Transportation ("NJDOT") State Aid to Counties and Municipalities FY2013 Municipal Aid ATP Program ("NJDOT Municipal Aid ATP Program") provides grant funding for the improvement and construction of local, municipal,and county road and bridge projects; and
      WHEREAS, the City of Newark needs to improve various roads throughout the City of Newark; and
 
      WHEREAS, the City of Newark desires to further the public interest by obtaining funding from the NJDOT Municipal Aid Program for improvements to various streets (7 locations) within the City of Newark; and
 
      WHEREAS, on December 19, 2012, NJDOT notified the City of Newark by letter that it would be entitled to an allotment of $1,501,000.00, pending receipt of an online grant application; and
 
      WHEREAS, on February 27, 2013, othe Director of the Department of Engineering, submitted an application to NJDOT requesting grant funding in the amount of $1,501,000.00 from the NJDOT Municipal Aid ATP Program, for improvements to various streets (7 locations) within the City of Newark, identified as application MA-ATP-2013-Newark City-00005 with no City funds required; and
 
      WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City of Newark is required to submit a resolution from the Newark Municipal Council authorizing submission of the grant application; and
 
      WHEREAS, the Director of the Department of Engineering desires to accept the grant award and execute a grant agreement governing said award; and
 
      WHEREAS the Director of Department of Engineering shall submit a copy of the grant agreement to the Corporation Counsel and the Business Administrator for review, approval and signature.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Municipal Council of the City of Newark formally approves the submission of the grant application for the above-stated project.
    2. The Mayor and/or his designees, the Director of the Department of Engineering and the City Clerk, are hereby authorized to submit an electronic grant application identified as MA-ATP-2013-Newark City-00005 to the New Jersey Department of Transportation on behalf of the City of Newark requesting grant funding in the amount of $1,501,000.00 from the NJDOT Municipal Aid ATP Program for improvements to various streets (7 locations) within the City of Newark with no City funds required (a copy of the application is attached hereto and made a part hereof).
    3. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
    4. The Municipal Council hereby accepts the grant award. .
    1. The Director of the Department of Engineering and the City Clerk, are hereby authorized to sign the grant agreement on behalf of the City of Newark and their signature constitutes acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement.
    1. The Director of the Department of Engineering shall submit a complete copy of the grant agreement and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval and signature.

STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designees, the Director of the Department of Engineering and the City Clerk, to submit the electronic grant application identified as MA-ATP-2013-Newark City-00005 to the New Jersey Department of Transportation on behalf of the City of Newark requesting grant funding in the amount of $1,501,000.00 from the NJDOT FY2013 Municipal Aid ATP Program for improvements to various streets (7 locations) within the City of Newark and accept the grant funding, with no City of Newark funds required.
 
My signature and the Clerk's seal serve to acknowledge the above-resolution and constitute acceptance of the terms and conditions of the grant agreement and approve the execution of the grant agreement as authorized by the resolution above.
