      WHEREAS, the Division of Traffic and Signals, Department of Engineering, City of Newark, advertised for receipt of bids on June 5, 2012, June 12, 2012 and June 19, 2012, and on July 19, 2012, three (3) bids were received,  and based on a review of the bids, the Director of the Department of Engineering accepted the bid proposal submitted by the lowest responsible bidder Kevco Electric, Inc., 62-84 Arlington Avenue, Bloomfield, New Jersey 07003, for the total bid amount of $629,518.80 for Contract No. 09-2011, Wilson Avenue Intersection Improvements; and
 
      WHEREAS, on January 10, 2013 the lowest bidder, Kevco Electric, Inc., rescinded its bid for Contract No. 09-2011, Wilson Avenue Intersection Improvements, because of the time delay; and
 
      WHEREAS, given the length of time that had passed between the receipt of bids and the date of the withdrawal of the Kevco Electric, Inc., the Division of Traffic and Signals, Department of Engineering, City of Newark, readvertised for receipt of bids on January 24, 2013, January 31, 2013 and February 7, 2013, for Contract No. 09-2011(R), Wilson Avenue Intersection Improvements; and
 
WHEREAS, on February 21, 2013, four (4) bids were received for Contract No. 09-2011(R), Wilson Avenue Intersection Improvements, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
 
      WHEREAS, based on a review of the bids, the Director of the Department of Engineering desires to accept the bid proposal submitted by the lowest responsible bidder FAI-GON Electric Inc., 140 11th Street, Piscataway, New Jersey 08854 and execute Contract No. 09-2011(R), Wilson Ave Intersection Improvements, for the total bid amount of $673,998.35.
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
  1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to accept the bid proposal submitted by the lowest responsible bidder, FAI-GON Electric Inc., 140 11th Street, Piscataway, New Jersey 08854, and execute Contract No. 09-2011(R), Wilson AvenueIntersection Improvements, for the total bid amount of $673,998.35.
  2. Attached hereto are the Certification of Funds issued by the Chief Financial Officer, which states that there are available sufficient legally appropriated funds for the purpose set forth hereinabove within: Fund 051, Dept. G10, Project E10V0, Account 71980, Budget Year B2010 in the amount of $500,000.00 and within Fund 045, Dept. 007, Project 07B10, Account 94710,  Budget Year B2007 in the amount of $173,998.35 for a total amount of $673,998.35.  Copies of the Certification of Funds issued shall be filed in the Office of the City Clerk by the Director of the Department of Engineering together with this resolution.
  3. No changes to this contract are allowed without prior Municipal Council approval.
  4. A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
  5. The term of this contract is three hundred sixty-five (365) consecutive calendar days from the date of issuance of a formal Notice to Proceed by the Director of the Department of Engineering.
  6. The public bidding process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq., complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq.
  7. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such award, in accordance with NJSA 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
 
 
 
 
STATEMENT
 
This resolution authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to accept the bid proposal submitted by the lowest responsible bidder, FAI-GON Electric Inc., 140 11th Street, Piscataway, New Jersey 08854, and execute Contract No. 09-2011(R), Wilson Ave Intersection Improvements, for the total bid amount of $673,998.35, within the period beginning three hundred sixty-five (365) consecutive calendar days from the date of issuance of a formal Notice to Proceed by the Director of the Department of Engineering.
