WHEREAS, the United States Department of Justice ("USDOJ") has made funds available through its Second Chance Adult and Juvenile Offender Reentry Demonstration Program ("Second Chance Reentry Projects"), which encouraged cities to develop community-based strategies to reduce crime, violence, and recidivism by fifty percent within a five-year period; and
WHEREAS, the Office of Reentry of the Department of Economic and Housing Development ("DEHD") in conjunction with the Office of the Business Administrator, authorized by Resolution 7R3-a, adopted March 2, 2011, prepared a proposal and application to USDOJ for the Newark Crime Prevention and Recidivism Reduction Initiative ("NCPRRI"); and
WHEREAS, the USDOJ awarded the City a $750,000.00 grant for these services and has approved a budget that includes expenditures of $684,225.00 for Case Management, Job Placement, and Transitional Employment Services for 150 young adults, ages 18 to 30; and
WHEREAS, pursuant to Resolution 7R3-a, adopted March 2, 2011, the City accepted grant funds and entered into a grant agreement with USDOJ, for the grant award 2010-CZ-BX-0060, in the amount of $750,000.00, for the NCPRRI, for the period commencing on October 1, 2010 and terminating on September 30, 2011; and
WHEREAS, the term for the above grant agreement was subsequently amended twice through Resolution 7R1-a 110711 and Resolution 7R3-d 060612, for the currently amended term of October 1, 2010 through December 31, 2012; and
WHEREAS, a third amendment to the grant agreement, which would extend the grant expiration date from December 31, 2012 to December 31, 2013, is pending for Municipal Council review; and
WHEREAS, the City issued a Request for Proposals (RFP) subject to the New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, to obtain proposals from organizations to provide Case Management, Job Placement, and Transitional Jobs Services for NCPRRI; and
WHEREAS, 12 organizations submitted proposals to provide services in response to the City's RFP; and
WHEREAS, the proposals were reviewed and evaluated by staff from the Department of Economic and Housing Development, the Business Administrator's Office, formerly incarcerated individuals, and select community organizations (the "Review Committee"); and
WHEREAS, the Review Committee selected Fund for the City of New York/The Center for Court Innovation ("Newark Community Solutions" or "NCS"), based on its Proposal, as one of the organizations ("Sub-Grantees") best qualified to provide services for NCPRRI; and
WHEREAS, pursuant to Resolution 7R3-m 090612, the Municipal Council authorized the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute a Contract (the "NCS Contract") with NCS to provide Case Management Services, in an amount not to exceed $54,067.00, for the period of April 1, 2012 and terminating on December 31, 2012 (the "Original Contract Term"); and
WHEREAS, DEHD, through the Office of Reentry, seeks to amend Resolution 7R3-m 090612 and enter into a First Amended NCS Contract to extend the expiration date of the contract from December 31, 2012 to December 31, 2013 and add three (3) additional provisions to the scope of services; and
WHEREAS, the First Amended NCS Contact is contingent on Municipal Council approval of the third amendment to the grant agreement authorized by Resolution 7R3-a 032011.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a First Amended NCS Contract, in the form attached hereto, with Fund for the City of New York/The Center for Court Innovation (NCS), located at 121 Avenue of the Americas, 6th Floor, New York, New York 10013, which will extend the expiration date of the Contract from December 31, 2012 to December 31, 2013. The First Amended NCS Contract is contingent on Municipal Council approval of the third amendment to the grant agreement.
2. The NCS Contract shall be further amended to add the following additional provisions to the scope of services:
a. NCS agrees to continue to provide ongoing Reentry Services to the Participants already enrolled in its program through the Extended Contract Term, as deemed necessary by NCS.
b. To the extent that one or more benchmarks is not achieved at the end of the Original Contract Term, NCS may use the Extended Contract Term to achieve and invoice for meeting the benchmarks, if any.
c. NCS shall submit a budget for the Extended Contract Term based on the amount available for reimbursement remaining on its contract as of December 31, 2012.
3. No Municipal funds are required.
4. This resolution and a fully executed copy of the First Amended NCS Contract shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
5. All other terms and conditions contained in the NCS Contract authorized pursuant to Resolution 7R3-m 090612 shall remain in full effect and in accordance with the law.
6. The Municipal Council hereby ratifies the contract amendment from December 31, 2012 to the date of adoption of this resolution.
