WHEREAS, pursuant to Resolution 7R1-f, authorized on May 18, 2011, the Municipal Council authorized the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute an agreement with YouthBuild Newark ("Sub-recipient"), in the amount of $100,650.00, for the term of January 1, 2011-December 31, 2012 ("Sub-recipient Agreement") to provide Public Facilities Development/Rehabilitation to its facility located at 646-650 Fifteenth Avenue, Newark, New Jersey; and
WHEREAS, pursuant to Resolution 7R3-b, authorized on March 7, 2012, the Municipal Council authorized the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute a First Amended Sub-recipient Agreement with the Sub-recipient to extend the expiration date of the Sub-recipient Agreement from January 1, 2011-December 31, 2012 to allow the Sub-recipient to complete the physical rehabilitation to its facility located at 646-650 Fifteenth Avenue, Newark, New Jersey; and
WHEREAS, the Sub-recipient has requested authorization for a Second Amended Sub-recipient Agreement extending the Sub-recipient Agreement for an additional six (6) months for an amended period of January 1, 2011 to June 30, 2013, to allow the Sub-recipient to complete the physical rehabilitation to its facility located at 646-650 Fifteenth Avenue, Newark, New Jersey; and
WHEREAS, this project does not require the use of additional funds and all other terms and conditions contained in Sub-recipient Agreement authorized under Resolution 7R1-f 051811 shall remain in full force and effect.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a Second Amended Sub-recipient Agreement, in the form attached hereto, with YouthBuild Newark, 60 Park Place, Suite 323 , Newark, New Jersey 07102 (the Sub-recipient to extend the term of the Sub-recipient Agreement for an additional six (6) months for an amended period of January 1, 2011 to June 30, 2013, to allow the Sub-recipient to complete the physical rehabilitation to its facility located at 646-650 Fifteenth Avenue, Newark, New Jersey.
2. The Second Amended Sub-recipient Agreement between the City of Newark and the Sub-recipient is hereby ratified from December 31, 2012 to the date of adoption of this authorizing resolution.
3. This resolution and a fully executed copy of the Second Amended Sub-recipient Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
4. This project does not require the use of additional funds and all other terms and conditions contained in the Sub-recipient Agreement authorized pursuant to Resolution 7R1-f 051811shall remain in full force and effect in accordance with the law.
STATEMENT
