WHEREAS, pursuant to Resolution 7R3-j 090612, the Municipal Council authorized the Deputy Mayor/Director of the Department of Economic & Housing Development, on behalf of the Business Administrator and the City of Newark, to enter into and execute a fair and open agreement with CURA, Inc., 35 Lincoln Park, Newark, New Jersey 07102, for the purpose of providing physical rehabilitation services to its facility located at 75 Lincoln Park, Newark, NJ  07102, Block 123 Lot 42, Central Ward, in an amount not to exceed $179,400.00; and
 
WHEREAS, the Deputy Mayor/Director, Department of Economic & Housing Development wishes to amend Resolution 7R3-j 090612 and the Sub-recipient Agreement authorized therein to extend the term of the Sub-recipient Agreement from January 1, 2012 through December 31, 2012 to January 1, 2012 through December 31, 2013 to allow  the Sub-recipient to complete physical rehabilitation services to its facility.
 
      NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designees, the Business Administrator and the Deputy Mayor/Director of the Department of Economic & Housing Development, are hereby authorized to enter into a First Amended Sub-recipient Agreement, in the form attached hereto, with CURA, Inc., 35 Lincoln Park, Newark, New Jersey 07102, the (Sub-recipient) to extend the term of the Sub-recipient Agreement from January 1, 2012 through December 31, 2012 to January 1, 2012 through December 31, 2013 to allow  the Sub-recipient to complete the physical rehabilitation to its facility at 75 Lincoln Park, Newark, New Jersey 07102.
 
2.      The First Amended Sub-recipient Agreement between the City of Newark and the CURA, Inc., is hereby ratified from December 31, 2012 to the date of adoption of this authorizing resolution
 
3.      No additional City funds are required for the First Amended Sub-Agreement.
 
4.      Except as amended herein, all other terms and conditions of the Sub-recipient Agreement, approved and authorized by Resolution 7R3-j September 6, 2012, shall remain in full force and effect.
 
5.      The First Amended Sub-recipient Agreement is in compliance with the Local Public Contracts Law including, but not limited to N.J.S.A. 40A:11-4.1(b)(2) and/or N.J.S.A. 40A:11-5, and Community Development Block Grant, 24 CFR 135 (section #3 reporting requirements) and 24 CFR. 570.201(c).
 
6.      An executed copy of the First Amended Sub-recipient Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic & Housing Development on behalf of the Business Administrator.
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designees, the Business Administrator and the Deputy Mayor/Director of the Department of Economic & Housing Development, to enter into and execute a First Amended Sub-recipient Agreement with CURA, Inc., 35 Lincoln Park, Newark, New Jersey 07102, to extend the term of the Sub-recipient Agreement from January 1, 2012 through December 31, 2012 to January 1, 2012 through December 31, 2013.  The First Amended Agreement is hereby ratified from December 31, 2012 until date of adoption of this resolution. Except as amended herein and all other terms and conditions approved and authorized under Resolution 7R3-j 090612 shall remain in full effect
