WHEREAS, The Clean Communities Act P.L. 1996, c. 187, established a grant fund from which grants may be made to municipalities in order to encourage increased anti-litter campaigns; and
 
WHEREAS, the City of Newark is eligible to receive an annual grant under the Clean Communities Act of the State of New Jersey (N.J.S.A.13:1E-217), administered by the New Jersey Department of Environmental Protection (NJDEP), to create or to supplement an existing litter reduction program within the municipality; and
 
WHEREAS, it is the intent of this Act to use the grants to develop new municipal anti-litter programs and to continue and expand existing programs; and
 
WHEREAS, municipalities are required to plan and implement a program, which combines the elements of litter clean-up and removal, enforcement of   litter related laws and ordinances, litter abatement, public information and education, and encourage the proper handling of solid waste; and
 
WHEREAS, it is the desire of the City of Newark to provide a clean, litter-free environment for its citizens; and
 
WHEREAS, the Clean Communities Entitlement Program does not require a grant application or New Jersey Department of Environmental Protection (NJDEP) approval in order to obtain a grant award; and
 
 
WHEREAS, a resolution authorizing the City of Newark to accept such grants confirms its commitment to anti-litter activities and indicates the assent of the City of Newark to the efforts, undertaken and the requirements contained in the Clean Communities Act; and
 
WHEREAS, the City of Newark has been awarded a grant from the Clean Communities Entitlement Program for programs of litter pick-up and removal, and the abatement of graffiti, for the period commencing January 1, 2010 and terminating on December 31, 2010, in the amount of $327,344.66 with no additional Municipal funds required.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:
 
1.      The 2010 Clean Communities Entitlement Program grant award for $327,344.66 is hereby accepted (a copy of the grant award and check is attached hereto and made a part hereof).
 
2.      The Mayor and/or his designee, the Director of Neighborhood and Recreational Services, are hereby authorized to enter into and execute grant documents with the Clean Communities Entitlement Program to receive and expand the grant award for litter pick-up, removal and the abatement of graffiti, for the period commencing January 1, 2010 and terminating on December 31, 2010 (copy of the 2010 Clean Communities Entitlement Program Fact Sheet is attached hereto ad made a part hereof)
 
3.      The Agreement between the City of Newark and the Clean Communities Entitlement Program is hereby ratified from January 1, 2010 to the date of adoption of this authorizing resolution.
 
4.      In the event that additional 2010 Clean Communities grant funding is awarded to the City of Newark, the additional grant funding is hereby accepted and shall be used by the Director of Neighborhood and Recreational Services for the Clean Communities Program in accordance with the grant requirements and all other conditions of this grant award, as well, all additional grant awards and associated grant documentation shall be filed with the Office of the City Clerk by the Director of the Department of Neighborhood and Recreational Services.
 
5.      The Department of Neighborhood & Recreational Services will be responsible for the Clean Community Program's implementation, and the Director of Neighborhood & Recreational Services is hereby designated as the Clean Community Coordinator.
 
6.      No Municipal funds are required for receipt or acceptance of the grant award.
 
7.      The Director of the Department of Neighborhood & Recreational Services shall file a fully executed copy of the grant award letter, the Grant Agreement, and any other associated grant documentation with the Office of the City Clerk.
 
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of Neighborhood and Recreational Services to accept grant funds, enter into and execute a Grant Agreement with the Clean Communities Entitlement Program for 2010 to provide litter pick-up, removal and the abatement of graffiti City-wide for the period commencing on January 1, 2010 and terminating on December 31, 2010, in the grant amount of $327,344.66.  No Municipal funds are required.
