WHEREAS, pursuant to Resolution 7R3-c, authorized on June 7, 2012, the Municipal Council authorized the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute a First Amended Sub-recipient Agreement to amend the scope of services and extend the term of the Sub-recipient Agreement from January 1, 2011-December 31, 2011 to January 1, 2011 to December 31, 2012, to allow the Sub-recipient to complete the project; and
 
WHEREAS, the Sub-recipient has requested authorization for a Second Amended Sub-recipient Agreement extending the Sub-recipient Agreement for an additional nine (9) months for an amended period of January 1, 2011 to September 30, 2013, to allow the Sub-recipient to complete the physical rehabilitation to its facility, 23 Broadway, Newark, New Jersey  07104; and
 
WHEREAS, this project does not require the use of additional funds and all other terms and conditions contained in contract authorized under Resolution 7R3-c 060712, as subsequently amended, shall remain in full force and effect.  
            
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a Second Amended Sub-recipient Agreement, in the form attached hereto, with La Casa de Don Pedro, Inc., 75 Park avenue, Newark, New Jersey 07104,(hereinafter referred to as the Sub-recipient) to amend the term of the Agreement from January 1, 2011 through December 31,2012 to January 1, 2011 through September 30, 2013 to allow Sub-recipient to complete the physical rehabilitation to its facility located at 23 Broadway, Newark, New Jersey  07104.
 
2.      The Second Amended Sub-recipient Agreement between the City of Newark and the sub-recipient is hereby ratified from December 31, 2012 to the date of adoption of this authorizing resolution.
 
3.      This resolution and a fully executed copy of the Second Sub-recipient Amended Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
 
4.      This project does not require the use of additional funds and all other terms and conditions contained in the Sub-recipient Agreement authorized pursuant to Resolution 7R3-c 060712, as subsequently amended, shall remain in full effect and in accordance with the law.
 
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute a Second Amended Sub-recipient Agreement, in the form attached hereto, with La Casa de Don Pedro, Inc., to amend the term of the First Amended  Sub-recipient Agreement from January 1, 2011 through December 31, 2012 to January 1, 2011 through September 30, 2013, to allow the Sub-recipient to complete the rehabilitation to its facility located at 23 Broadway, Newark, New Jersey  07104.
