WHEREAS, an emergency has arisen in the Special Item of Appropriation in the amount of $1,547,510.26 for Municipal Recycling Tonnage Grant for program years 2006 through 2011 and no adequate provision has been made in the 2013 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose abovementioned; and
WHEREAS, by annual grant funding to the City of Newark by the New Jersey Department of Environmental Protection Agency pursuant to the Municipal Tonnage Act of State of New Jersey, (N.J.S.A3 13:1E-99.37 et seq., as amended by P.L. 1989, C. 108) for City's Municipal Tonnage Grant Program, funds for program years 2006 through 2011 in the amount of $1,547,510.26 are to supplement an existing litter reduction program within the municipality for program period August 1, 2012 through July 31, 2013; and
WHEREAS, N.J.S.A. 40A:4-20 provides that the governing body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and.
WHEREAS, the emergency appropriations adopted in 2013 pursuant to N.J.S.A. 40A:4-20 including this resolution total $120,835,742.01.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

STATEMENT
This legislation establishes the appropriation for Municipal Recycling Tonnage Grant for program years 2006 through 2011 in the amount of $1,547,510.26. These funds have been awarded by New Jersey Department of Environmental Protection Agency to supplement an existing litter reduction program within the municipality. (City-wide)
