WHEREAS, through Resolution 7R10-a dated February 6, 2013, the City of Newark closed out and re-appropriated balances of grant funds received from New Jersey Department of Environmental Protection (NJDEP) under Municipal Tonnage Grant, as follows:

WHEREAS, additional balances from the Municipal Tonnage Grant years 2008, 2010 and 2011, in the amount of $727,155.91 must be closed out and re-appropriated into the August 1, 2012 through July 31, 2013 Municipal Tonnage Program and Municipal Tonnage 2007 in the amount of $128,363.00 was inaccurately included in Resolution 7R10-a dated February 6, 2013 and must be amended as follows:

for a total allocation of $1,547,510.26 to operate the City's Municipal Tonnage Program from August 1, 2012 through July 31, 2013; and
WHEREAS, to receive, accept and re-appropriate these funds it is necessary to modify the City's Municipal Tonnage Grant pursuant to the Municipal Tonnage Act of the State of New Jersey, (N.J.S.A 13:1E-99.37 et seq., as amended by P.L. 1989, C. 108) for program years 2006 through 2011 in the amount of $1,547,510.26, for the period commencing August 1, 2012 through July 31, 2013; and
WHEREAS, the Mayor and/or the Director of Neighborhood and Recreational Services seek to amend Resolution 7R10-a dated February 6, 2013, to add the additional funds in the amount of $855,518.91 into the City's Municipal Tonnage Program and delete the Municipal Tonnage 2007 for $128,363.00 which was inaccurately included in Resolution 7R10-a dated February 6, 2013, for a total allocation of $727,155.91 to be added to the August 1, 2012 through July 31, 2013 program period; and
WHEREAS, the funds will be used by the City of Newark to provide a clean, litter free environment for its citizens for program year August 1, 2012 through July 31, 2013.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Director of Neighborhood and Recreational Services are hereby authorized to receive, accept and re-appropriate the Municipal Tonnage Grant to include additional balances from years 2008, 2010, 2011 and delete Municipal Tonnage 2007 for $128,363.00 pursuant to the Municipal Tonnage Act of the State of New Jersey, (N.J.S.A 13:1E-99.37 et seq., as amended by P.L. 1989, C. 108) and execute grant documents that may be necessary to effectuate this purpose.
2. The City's Municipal Tonnage Grant allocation as set forth in Resolution 7R10-a dated February 6, 2013 in the amount of $820,354.35 is amended by $727,155.91 for a total allocation of $1,547,510.26 for the program period commencing August 1, 2012 through July 31, 2013; as detailed herein:

3. The Municipal Council hereby ratifies its authorization of the actions of the Mayor and/or his designee the Director of Neighborhood and Recreational Services from August 1, 2012 to the date of adoption of this authorizing resolution.
4. All funds shall be expended in accordance with the terms of the Municipal Tonnage Grant Program.
5. The Director of the Department of Neighborhood and Recreational Services shall forward an executed copy of grant documents to the City Clerk.
6. No municipal funds are required for receipt of this grant.
STATEMENT
This resolution amends Resolution 7R10-a dated February 6, 2013 and authorizes the Mayor and/or his designee, the Director of Neighborhood and Recreational Services to enter into and execute revised grant documents with the New Jersey Department of Environmental Protection (NJDEP) under the Municipal Tonnage Grant to add additional funds in the amount of $855,518.91 into the City's Municipal Tonnage Program and delete the Municipal Tonnage 2007 amount of $128,363.00 which was inaccurately included in Resolution 7R10-a dated February 6, 2013, for a total allocation of $727,155.91 to be added to the August 1, 2012 through July 31, 2013 program period for a total allocation of $1,547,510.26.
