Additional Information:  
This is a partial award, based on 50 percent of previous year formula funding and 45 percent of previous year MAI funding. The balance of award will be determined when the congressional budget is established.

WHEREAS, the Department of Child and Family Well-Being/Ryan White Unit desires to continue to provide health, supportive and related services to HIV/AIDS infected and affected individuals of the Newark Eligible Metropolitan Area (EMA) which is comprised of Essex, Union, Morris, Sussex and Warren Counties; and
 
WHEREAS, the Department of Health and Human Services/Health Resources and Services Administration (HRSA), has made funds available for the provision of such services; and
 
WHEREAS, on October 22, 2012, on behalf of the City of Newark, the Director of the Department of Child and Family Well-Being submitted an application to the Department of Health and Human Services/Health Resources and Services Administration (HRSA), 5600 Fishers Lane, Rockville, Maryland 20857, requesting funding in the amount of twenty-one million dollars and no cents ($21,000,000.00), for the continued provision of HIV/AIDS health, supportive and related services to infected and affected individuals and families in the City of Newark and the Newark Eligible Metropolitan Area (EMA); and
 
WHEREAS, as a result of this application, the City of Newark has been awarded a partial grant in the amount of five million, three hundred twenty-nine thousand, eight hundred three dollars and no cents ($5,329,803.00) from the Department of Health and Human Services/Health Resources and Service Administration (HRSA), for the continued provision of HIV/AIDS health, supportive and related services to infected and affected individuals and families in the Newark Eligible Metropolitan Area (EMA) for the period commencing on March 1, 2013 and terminating on February 28, 2014; and
 
WHEREAS, the City of Newark, Department of Child and Family Well-Being desires to accept funds in the amount five million, three hundred twenty-nine thousand, eight hundred three dollars and no cents ($5,329,803.00); and
 
WHEREAS, the Department of Health and Human Services/Health Resources and Services Administration (HRSA) does not require the City to execute a grant agreement in order to accept the grant award; and
 
WHEREAS, the City of Newark recognizes that the Department of Health and Human Services/Health Resources and Services Administration (HRSA) may extend the time of the Grant Award and will provide additional funding when they are made available; and
 
WHEREAS, the Department of Health and Human Services/Health Resources and Services Administration (HRSA) will amend the grant to reflect a  time extension and/or award of additional funding if made available; and
 
WHEREAS, the City of Newark wishes to agree to any amendments to the Grant.
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
    1. The Mayor and/or his designee, the Director of the Department of Child and Family Well-Being is hereby authorized to submit an application to the Department of Health and Human Services/Health Resources and Services Administration (HRSA), 5600 Fishers Lane, Rockville, Maryland 20857, requesting funds in the amount of twenty-one million dollars and no cents ($21,000,000.00), for the continued provision of health, supportive and related services to infected and affected individuals and families in the Newark Eligible Metropolitan Area (EMA) with no City funds required (a copy of the application is attached hereto and made a part hereof).
    2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
    3. The grant award in the amount of five million, three hundred twenty-nine thousand, eight hundred three dollars and no cents ($5,329,803.00), from the Department of Health and Human Services/Health Resources and Services Administration (HRSA) is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).
    1. The Mayor and/or his designee, the Director of the Department of Child and Family Well-Being are hereby authorized to receive and expend the grant award for the continued provision of HIV/AIDS health, supportive and related services to infected and affected individuals and families in the Newark Eligible Metropolitan Area (EMA) for the period commencing on March 1, 2013 and terminating on February 28, 2014 (a copy of the grant award is attached hereto and made a part hereof).
    1. The Municipal Council hereby ratifies the acceptance of this grant award from March 1, 2013 to the date of adoption of this authorizing resolution.
    1. The Mayor and/or his designee, the Director of the Department of Child and Family Well-Being, is hereby authorized to accept and expend additional Ryan White funds, which will be inserted into the current budget as they become available from the United States Department of Health and Human Services, Health Resources Services Administration (HRSA).
    1. No municipal funds are required for receipt or acceptance of this grant award.
    2. The Director of the Department of Child and Family Well-Being shall file a fully executed copy of the grant application and notice of grant award in the Office of City Clerk.
 
 
STATEMENT
 
This resolution ratifies and authorizes the actions taken by the Director of the Department of Child and Family Well-Being to submit an application for grant funding from the Department of Health and Human Services/Health Resources and Services Administration (HRSA), 5600 Fishers Lane, Rockville, Maryland 20857, for the continued provision of health, supportive and related services to infected and affected individuals and families in the Newark Eligible Metropolitan Area (EMA) and furthermore, ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Child and Family Well-Being to accept grant funds in the amount of five million, three hundred twenty-nine thousand, eight hundred three dollars and no cents ($5,329,803.00), for the period commencing on March 1, 2013 and terminating on February 28, 2014. No municipal funds are required from the municipal budget.
