            WHEREAS, an emergency has arisen in the Special Item of Appropriation in the amount of $327,344.66 for 2010 Clean Communities Program  and no adequate provision has been made in the 2013 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose abovementioned;  and
 
WHEREAS, funds administered from New Jersey Department of Environmental Protection Agency under the Clean Communities Act, N.J.S.A. 13:1E-217 et seq. (“Act”), established a grant fund, entitled the “Clean Communities Entitlement Program”, the City of Newark accepted the 2010 Clean Communities Program funds in the amount of $327,344.66, to provide funds to supplement an existing litter reduction program and removal as well as the abatement of graffiti within the municipality; and
 
            WHEREAS, N.J.S.A. 40A:4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and.
 
            WHEREAS, the emergency appropriations adopted in 2013 pursuant to N.J.S.A. 40A:4-20 including this resolution total $160,176,110.67.
 
            NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
    1. An emergency appropriation be and the same is hereby made for the following classification:
    1. Program                              Amount
    2. 2010 Clean Communities Program      $327,344.66
    1. Said emergency appropriation shall be provided for in the 2013 budget.
    2. A copy of this resolution shall be filed with the Director of the Division of Local Government Services by the City Clerk of the City of Newark.
 
 
STATEMENT
 
This legislation establishes the appropriation for the 2010 Clean Communities Program in the amount of $327,344.66.  These funds have been awarded by New Jersey Department of Environmental Protection Agency.  The project period is January 1, 2010 through December 31, 2013 (City-wide).
