WHEREAS, the City of Newark advertised a Request for Proposal (RFP) for Budget Advisory Services to the Department of Finance of the City of Newark (hereinafter, Budget Advisory Services)and two (2) proposals were received on April 19, 2013; and
WHEREAS, the RFP solicited proposals from interested persons and/or firms which are Registered Municipal Accountants or a Certified Municipal Finance Officer with considerable direct experience preparing financial documents for municipalities, all of which are professional services, excluded from the requirement of public bidding pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-5(1)(a)(i); and
WHEREAS, the proposal received from Bowman & Company LLP, 601 White Horse Road, Voorhees, New Jersey 08043, was found to be in the best interest of the City of Newark to accept, price and other factors considered; and
WHEREAS, the City of Newark wishes to enter into a professional services contract with Bowman & Company LLP, 601 White Horse Road, Voorhees, New Jersey 08043 to provide Budget Advisory Services for the City of Newark, Department of Finance; and
WHEREAS, Bowman & Company, LLP, 601 White Horse Road, Voorhees, New Jersey 08043 has completed and submitted a City Political Disclosure Statement which certifies that the Business Entity, as that term is defined in the Local Pay-to-Play Law N.J.S.A 19:44A-20.5 and the City of Newark's Executive Order on Pay-to-Play Reform, MEO-07-001, have not made or solicited any prohibited contributions to a political or candidate committee in the City of Newark in the previous one year, and that the contract will prohibit Bowman & Company LLP from making or soliciting any prohibited contributions through the term of the contract; and
WHEREAS, this contract is for an amount over $17,500 and is being awarded as a fair and open contract pursuant to the Local Pay-to-Play Law ,N.J.S.A. 19:44A-20.5.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
- The Mayor and/or his designee, Director of Finance/CFO, are hereby authorized and directed on behalf of the City of Newark to execute a contract with Bowman & Company LLP, 601 White Horse Road, Voorhees, New Jersey 08043 to provide Budget Advisory Services to the Department of Finance, City of Newark, in the amount of $89,996.00.
- Pursuant to N.J.A.C. 5:30-5.5, attached hereto is a partial Certification of funds from the Director of Finance which states the funds in the amount of $89,000.00 are available in the 2013 Budget, Business unit 011, Dept.050, Div./Proj. 0501, Account# 71250. The certification shall be filed along with the original resolution and the executed contract in the Office of the City Clerk Director of Finance/CFO. The remainder of the funding for this contract will be subject to appropriation in the 2013 Municipal Budget and funds will be certified prior to services being provided by the contractor.
- This contract is being awarded pursuant to the fair and open procedures of the Pay-to-Play Law N.J.S.A 19:44A-20.5 and pursuant to the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-5 (1)(a)(i)), and is in compliance with Executive Order MEO-07-0001, effective March 31, 2007.
- Bowman & Company LLP has completed a City Political Disclosure Form, which shall be placed on file in the City Clerk's Office by the Director of Finance/CFO, certifying that they have not made or solicited any prohibited contributions to a political or candidate committee in the City of Newark in the previous year, and that the contract will prohibit Bowman & Company LLP from making or soliciting any prohibited contributions through the term of the contract.
- A copy of the executed contract herein authorized, , shall be filed in the Office of the City Clerk by the Director of Finance/CFO and shall be made available for public inspection.
- A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within 10 days of adoption
- This contract is for a period of 365 consecutive calendar days from the issue of a formal Notice to Proceed by the Director of Finance/CFO.
STATEMENT
This resolution authorizes a professional services contract between the City of Newark and Bowman & Company LLP, 601 White Horse Road, Voorhees, New Jersey 08043, to provide Budget Advisory Services to the Department of Finance, City of Newark, , for a period of 365 consecutive calendar days from the issuance of a formal Notice to Proceed by the Director of Finance/CFO, for the total amount of $89,996.00.
