WHEREAS, permission is required of the Director of the Department of Community Affairs, Division of Local Government Services, for approval to establish a Dedication by Rider for revenues received by a municipality when the revenue is not subject to reasonable accurate estimates in advance; and
WHEREAS, N.J.S.A.40A:4-29, provides that the Director of the Division of Local Government Services may approve the expenditures of money by
Dedication by Rider; and
WHEREAS, Municipal Ordinance No. 6S&FF adopted May 19, 1999, authorizes the Director of Finance to place all fees paid to the City of Newark by licensees for use of the public right-of-way for the provision of telecommunication services, referred to therein as Telecommunications Fees, , into a separate account that is dedicated to pay for infrastructure and right-of-way improvements and maintenance.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of Finance, is hereby authorized by the Municipal Council of the City of Newark to request permission of the Director of the Division of Local Government Services for the approval to establish a Dedication by Rider Trust for revenues received paid to the City of Newark by licensees for the use of the public right-of-wayay to provide telecommunication services, referred to as Telecommunications Feesand to expend those monies exclusively for infrastructure and right-of-way im...
