WHEREAS, the United States Department of Justice, Office of Juvenile Justice and Delinquency Prevention (USDOJ) made funds available through its Community-Based Violence Prevention Demonstration (CBVPD) Program, which encouraged cities to develop community-based strategies to reduce crime, violence and recidivism; and
WHEREAS, on May 23, 2011, the Newark Police Department (NPD), in partnership with the Office of Reentry, an initiative of the Department of Economic and Housing Development (DEHD), submitted an application to the USDOJ for CBVPD Program grant funds in the amount of $2,196,085.00 for the Newark Hotspot Initiative (Hotspot); and
WHEREAS, on August 31, 2011, USDOJ awarded the City a $2,196,085.00 grant and has approved a budget that includes expenditures of $630,000.00 for Case Management and Outreach Services for 150 at-risk young adults, ages 18 to 30; and
WHEREAS, through Resolution 7R3-a(s), adopted June 12, 2012, the City of Newark Municipal Council ratified and authorized the Newark Police Department (NPD), in partnership with Office of Reentry and the DEHD, to prepare the above application to USDOJ for grant funding in the amount of $2,196,085.00 for the Newark Hotspot Initiative (Hotspot) and further authorized the NPD and DEHD to accept said grant funds and enter into a cooperative agreement with USDOJ, for the grant award 2011-PB-FX-K001, in the amount of $2,196,085.00, for Hotspot, for the period commencing on October 1, 2011 and terminating on September 30, 2014; and
WHEREAS, on January 4, 2013 the NPD and DEHD requested an extension of grant agreement from September 30, 2014 to December 31, 2015, through the submission of a Grant Adjustment Notice to USDOJ, which was approved by USDOJ on February 12, 2013; and
WHEREAS, DEHD, through the Office of Reentry, is in need of Case Management and Outreach Services to assist in the implementation and administration of Hotspot; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.1(b) (2), a contract for such services may be awarded through a competitive contracting process; and
WHEREAS, the City of Newark issued a Request for Proposals on February 6, 2012, subject to the New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.4, to obtain proposals from vendors to provide Case Management and Outreach Services; and
WHEREAS, thirteen (13) vendors submitted proposals (the Proposals) in response to the City's RFP; and
WHEREAS, the Fund for the City of New York through its incubator project, the Center for Court Innovation (the Fund), a non-profit corporation organized and existing at 121 Avenue of the Americas, New York, New York, 10013 submitted a proposal to provide Case Management and Outreach Services to 150 at-risk young adults, ages 18 to 30, for Hotspot; and
WHEREAS, pursuant to the proposal, the Fund is going to utilize the Newark based agency Newark Community Solutions to spearhead Hotspot; and
WHEREAS, the Proposals were reviewed and evaluated by staff from the NPD, DEHD, and the Business Administrator's Office (the Review Committee); and
WHEREAS, the City, based upon the Review Committee's review of all proposals, wishes to enter into a contract with the Fund in the amount of $630,000.00 for the purpose of providing Case Management and Outreach Services to 150 at-risk young adults, ages 18 to 30, for Hotspot, based upon the Fund's intent to use a Newark-based agency to spearhead the project, its high ranking to the RFP and its prior experience and proven ability to serve at-risk individuals, including those in the City of Newark; and
WHEREAS, this contract is being awarded to a non-profit organization and as such is not governed by State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, or Newark Executive Order on Pay-to-Play Reform, MEO-07-0001; and
WHEREAS, the contract is funded solely through the Grant Award received from the USDOJ through its CBVPD Program.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

- The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development are hereby authorized to enter into and execute a Contract with the Fund for the City of New York through its incubator project, the Center for Court Innovation (the Fund), located at 121 Avenue of the Americas, New York, New York, 10013, for the purpose of providing case management and outreach services to 150 at-risk young adults, ages 18 to 30, for the Newark Hotspot Initiative, in an amount not to exceed $630,000.00, for the period commencing on January 15, 2013 and terminating on December 31, 2015.
- The Fund is going to utilize the Newark-based agency Newark Community Solutions, 31 Green Street, Room 310, Newark, New Jersey 07102 to spearhead Hotspot.
- The Municipal Council hereby ratifies its authorization of this Contract between the City of Newark and the Fund from January 15, 2013 to the date of adoption of this authorizing resolution.
- Attached hereto is a certification of funds from the Director of Finance of the City of Newark, which states that (1) there are available legally appropriated funds for the purpose set forth hereinabove in the amount of $630,000.00 and (2) that the line appropriation of the official budget which shall be charged is as follows:

- This contract is being awarded to the Fund pursuant to the provisions of the State Local Public Contracts Law (N.J.S.A. 40A:11-1, et seq.). Since the Fund is a non-profit organization, the procedures of the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, and Newark Executive Order MEO-07-0001, effective March 31, 2007, do not apply.

- A copy of the certification of funds and the fully executed contract herein authorized shall be filed in the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.

- A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of its passage.
STATEMENT

The Fund is going to utilize the Newark-based agency Newark Community Solutions,31 Green Street, Room 310, Newark, New Jersey 07102 to spearhead Hotspot. This contract is being awarded to the Fund pursuant to the provisions of the State Local Public Contracts Law (N.J.S.A. 40A:11-1, et seq.) and since the Fund is a non-profit organization the State Pay to Play Law, N.J.S.A. 19:44A-20.5, and Newark Executive Order MEO-07-0001 do not apply.
