RESUBMISSION 06.11.13 AFTER BEING RETURNED TO ADMINISTRATION IN ORDER TO BE VOTED ON BY MUNICIPAL COUNCIL.

      WHEREAS, the City of Newark is in need of Insurance Consulting/Brokerage and Risk Management Services in order to assist the City with obtaining and maintaining acceptable health insurance coverage (Medical/Prescription/Dental/Vision) for its employees; and
 
      WHEREAS, the City of Newark advertised a Request for Qualifications (RFQ) for Insurance Consulting/Brokerage Services from July 12, 2012 to July 24, 2012 which date was extended to August 3, 2012; and
 
      WHEREAS, nine (9) RFQ packages were distributed to prospective vendors following the date of the advertisement; and
 
      WHEREAS, on August 3, 2012, five (5) proposals were received in response to the advertisement; and
 
      WHEREAS, one (1) joint proposal was received from Brown & Brown Metro, Inc., (Principal Broker), and  Alamo Insurance Group, Inc.,(as Co-Broker)which will receive assignments from Brown and Brown, Metro ; and
 
      WHEREAS, the City of Newark found this proposal to be in the best interest of the City of Newark to accept; and
 
      WHEREAS, the City of Newark deemed it in the best interest of the City to enter into contract with  Brown & Brown Metro, Inc. (Principal Broker) and Alamo Insurance Group, Inc. (Co-Broker) to provide Insurance Consulting and Brokerage Services for the City of Newark commencing on January 1, 2013 and terminating on December 31, 2013; and
 
      WHEREAS, this contract is at no cost to the City of Newark because Brown & Brown Metro, Inc., (Principal Broker), and its Co-Broker, Alamo Insurance Group, Inc. work off of standard compensation received directly from insurance carriers; and
 
      WHEREAS, because this contract is  for insurance consultant services, it is being awarded as an exception to public bidding pursuant to Local Public Contracts Law (N.J.S.A. 40A:11-5(1)(m)), which requires it be awarded in accordance with the requirements of extraordinary unspecifiable services (N.J.S.A. 40A:11-5(1)(a)(ii)); and
 
      WHEREAS, Local Public Contacts Law N.J.S.A. 40A:11-1, et seq. requires a resolution of the Governing Body authorizing the award of contract for EUS and further requires the contract itself must be available for public inspection; and
 
      WHEREAS, this contract is being awarded as a fair and open contract pursuant to State Pay-to-Play Law (N.J.S.A. 19:44A-20.5); and
 
      WHEREAS, the Mayor of the City of Newark signed into law Executive Order Number MEO-07-0001 (hereinafter “Pay-to-Play Executive Order”), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract.
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
  1. The Mayor and/or his designees, the Business Administrator and the Director of Personnel, are hereby authorized to execute a contract with Brown and Brown Metro, Inc., 26 Columbia Turnpike, Florham Park, New Jersey 07932, to provide Insurance Consulting and Brokerage Services (Medical/Prescription/Dental/Vision) for the City of Newark, for the period commencing on January 1, 2013 and terminating on December 31, 2013.
  1. The Municipal Council hereby ratifies this contract from January 1, 2013 to the date of adoption of this authorizing resolution.
  1. This contract is at no cost to the City of Newark because Brown and Brown Metro, Inc. and its Co-Broker Alamo Insurance Group, Inc. work off of standard compensation received directly from insurance carriers.
  1. This contract is being awarded as an exception to public bidding pursuant to Local Public Contracts Law (N.J.S.A. 40A:11-5(1)(m)), and in accordance with the requirements of  Extraordinary Unspecifiable Service (N.J.S.A. 40A:11-5(1)(a)(ii)), and is in compliance with Newark Executive Order MEO-07-0001, effective March 31, 2007.
  1. This contract is being awarded as a fair and open contract pursuant to State Pay-to-Play Law (N.J.S.A. 19:44A-20.5).
  1. The Certification of Extraordinary Unspecifiable Service, as required by State Local Public Contracts Law (N.J.S.A. 40A:11-5(1)(a)(ii)), is attached hereto and shall be filed in the Office of the City Clerk with the original resolution.
  1. A copy of the executed contract herein authorized shall be filed in the Office of the City Clerk by the Business Administrator.
  1. A notice of this action shall be published in the newspaper as required by law within ten (10) days of the adoption of the Resolution.
 
STATEMENT
 
This resolution ratifies and authorizes the actions of the Mayor and/or his designees, the Business Administrator and the Director of Personnel, to enter into    a contract with Brown and Brown Metro, Inc., 26 Columbia Turnpike, Florham Park, NJ 07932, to provide Insurance Consulting and Brokerage Services (Medical/Prescription/Dental/Vision) for the City of Newark, for the period commencing on January 1, 2013 and terminating on December 31, 2013.
