WHEREAS, on November 8, 2012, by Resolution 7R3-A, the Municipal Council of the City of Newark authorized the Mayor to accept Youth Workforce Investment Act funds pursuant to the Workforce Investment Act of 1998 (WIA), in the amount of $2,087,149.00; and
WHEREAS, there exists a need for NewarkWORKS to enter into a contract with an entity that can provide educational services to twenty (20) clients in the area of business entertainment training pursuant to the provisions of the WIA for a period commencing on July 1, 2012 and terminating on June 30, 2013 with the funds to be fully expended by June 30, 2014; and
WHEREAS, on April 5, 2012 NewarkWORKS advertised a Request for Proposal, which was returnable on May 3, 2012 for the above-referenced educational services under the provisions of the WIA for Program Year 2012-2013 (a copy of the Request for Proposal is attached hereto and made part thereof); and
WHEREAS, on May 3, 2012, NewarkWORKS received Proposals from sixteen (16) entities, which were opened and entered on the tab bid sheet (a copy of which is attached and made part thereof); and
WHEREAS, the Proposal received from Junior Entrepreneurs Club Training Program, Inc. of 110 Mt. Pleasant Avenue, Newark, New Jersey 07104 was reviewed by a Selection Committee of the Newark Youth Investment Council and was found to be the most advantageous to the City of Newark based upon price, experience and all other criteria listed in the Request for Proposal; and
WHEREAS, NewarkWORKS wished to enter into a contract with Jr. Entrepreneurs Club Training Program, Inc. to provide the above-referenced business entertainment training under the WIA for twenty (20) clients in an amount not to exceed $63,000.00 for Program Year 2012-13 commencing July 1, 2012 and terminating on June 30, 2013, with all funds being fully expended no later than June 30, 2014; and
WHEREAS, the Municipal Council of the City of Newark wishes to authorize and ratify the use of competitive contracting for processing these WIA programs from April 5, 2012, to the date of adoption of this resolution and authorizes its use in the future; and
WHEREAS, this contract is being awarded pursuant to State Local Public Contracts Law, including N.J.S.A. 40A:11-4.1(b)(2) and/or N.J.S.A. 40A:11.5 and/or as educational services to N.J.S.A. 40A:11-5(1)(q) (as applicable), and the WIA; and
WHEREAS, this contract is being awarded pursuant to the Fair and Open Procedures of the State Pay-to-Play Law (N.J.S.A. 19:44A-20.5); and
WHEREAS, the Mayor of the City of Newark signed into law Executive Order Number MEO-07-0001 (Pay-to-Play Executive Order), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
- The Mayor and/or his designee(s), the Deputy Mayor/Director of Economic and Housing Development and Acting Deputy Director of Newark One Stop Career Center/NewarkWORKS are hereby authorized to enter into and execute a contract with Junior Entrepreneurs Club Training Program, Inc. of 110 Mt. Pleasant Avenue, Newark, New Jersey 07104 to provide training to twenty (20) clients in the area of business entertainment and placement/retention services under WIA Youth for Program Year 2012-2013 for the period commencing on July 1, 2012 and terminating on June 30, 2013 for an amount not to exceed $63,000.00.
- This contract between the City of Newark and Junior Entrepreneurs Club Training Program, Inc. is hereby ratified from July 1, 2012 to the date of adoption of the authorizing resolution.
- The Municipal Council of the City of Newark hereby authorizes and ratifies the use of competitive contracting for processing and awarding these WIA programs from April 5, 2012, to the date of adoption of this resolution and authorizes its use in the future.
- The contract is subject to the availability of funds from the U.S. Department of Labor, Employment and Training Administration, Workforce Investment Act of 1998 through the New Jersey Department of Labor and Workforce Development.
- Attached hereto is Certification of Funds from the Municipal Comptroller of the City of Newark, which states: (1) that there are sufficient funds, in the amount of $63,000.00 for purpose set forth hereinabove; and (2) that the line appropriation of the official budget which shall be charged is: Business Unit NW051, Department ID G013, Div/Proj. M1310, Activity A, Account #72060, Budget Reference B2013.
- There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.
- There shall be no amendment or changes to this contract without approval of the Municipal Council of the City of Newark.
- The Acting Deputy Director of Newark One Stop Career Center/NewarkWORKS shall file a copy of the fully executed contract in the Office of the City Clerk and shall be made available for public inspection.
- This contract is being awarded to a non-profit organization and as such is not governed by the State-Pay-to-Play Law, N.J.S.A. 19:44A-20-5, or Newark Executive Oder on Pay-to-Play Reform, MEO-07-0001.

This resolution ratifies and authorizes the Mayor, and/or his designee(s), the Deputy Mayor/Director of Economic and Housing Development and Acting Deputy Director of Newark One Stop Career Center/NewarkWORKS to enter into and execute a contract with Junior Entrepreneurs Club Training Program, Inc., of 110 Mt. Pleasant Avenue, Newark, New Jersey 07104 pursuant to the provisions of WIA, to provide training to twenty (20) clients in the area of business entertainment and placement/retention services under WIA Youth for Program Year 2012-2013 for a contract amount not to exceed $63,000.00 commencing July 1, 2012 and terminating on June 30, 2013, with all funds being fully expended no later than June 30, 2014.
