,    WHEREAS,  on November 8, 2012, by Resolution 7R3-A, the Municipal Council of the City of Newark authorized the Mayor to accept Youth Workforce Investment Act funds pursuant to the Workforce Investment  Act of 1998 (“WIA”), in the amount of $2,087,149.00; and
 
      WHEREAS, there exists a need for NewarkWORKS to enter into a contract with an entity that can provide educational services to forty (40) clients in the area of Academic Remediation training pursuant to the provisions of the WIA for a period commencing on July 1, 2012 and terminating on June 30, 2013 with the funds to be fully expended by June 30, 2014; and
 
      WHEREAS, on April 5, 2012 NewarkWORKS advertised a Request for Proposal, which was returnable on May 3, 2012 for the above-referenced  educational services under the provisions of the WIA for Program Year 2012-2013 (a copy of the Request for Proposal is attached hereto and made part thereof); and
 
WHEREAS,  on May 3, 2012, NewarkWORKS received proposals from sixteen (16) entities which were opened on May 3, 2012 and entered on the tab bid sheet, a copy of which is attached; and        
 
WHEREAS,  the proposal received from Children's Hospital of New Jersey (CHONJ) at Newark Beth Israel Medical Center, 201 Lyons Avenue, Newark, New Jersey  07112 was reviewed by a selection committee of the Newark Youth Investment Council and was found to be the most advantageous to the City of Newark based upon price, experience and all other criteria listed in the Request for Proposal; and
 
WHEREAS,  NewarkWORKS wishes to enter into a contract with Children's Hospital of New Jersey, to provide the above-referenced Academic Remediation Training under the WIA for forty (40) clients in an amount not to exceed $117,320.00 for Program Year 2012-13 commencing July 1, 2012 and terminating on June 30, 2013, with all funds being fully expended no later than June 30, 2014; and
 
WHEREAS, the Municipal Council of the City of Newark wishes to authorize and ratify the use of competitive contracting for processing these WIA programs from April 5, 2012, to the date of adoption of this resolution and authorizes its use in the future; and
 
WHEREAS,  this contract is being awarded pursuant to State Local Public Contracts Law, including N.J.S.A. 40A:11-4.1(b)(2) and/or N.J.S.A. 40A:11.5 and/or as educational services to N.J.S.A. 40A:11-5(1)(q) (as applicable), and the WIA; and
 
WHEREAS, this contract is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law (N.J.S.A. 19:44A-20.5); and
 
WHEREAS,  the Mayor of the City of  Newark signed into law Executive Order Number MEO-07-0001 (“Pay-to-Play Executive Order”), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:     
  1. The Mayor and/or his designee(s), the Deputy Mayor/Director of the Department of Economic and Housing Development and Acting Deputy Director of NewarkWORKS are hereby authorized to enter into and execute a contract with Children's Hospital of New Jersey (CHONJ) at Newark Beth Israel Medical Center, 201 Lyons Avenue, Newark, New Jersey 07112 to provide training to forty (40) clients in the area of Academic Remediation training and placement/retention services under WIA Youth for Program Year 2012-2013 for the period commencing on July 1, 2012 and terminating on June 30, 2013 for an amount not to exceed $117,320.00.
  1. The Municipal Council hereby ratifies this contract between the City of Newark and Children's Hospital of New Jersey at Newark Beth Israel Medical Center from July 1, 2012 to the date of adoption of the authorizing resolution.
  1. The Municipal Council of the City of Newark hereby authorizes and ratifies the use of competitive contracting for processing and awarding these WIA programs from April 5, 2012, to the date of adoption of this resolution and authorizes its use in the future.
  1. The contract is subject to availability of funds from the United States Department of Labor, Employment and Training Administration, Workforce Investment Act of 1998 through the New Jersey Department of Labor and Workforce Development.
  1. Attached hereto is certification of funds from the Municipal Comptroller of the City of Newark, which states (1) that there are sufficient funds, in the amount of $117,320.00 for purpose set forth hereinabove and (2)  that the line appropriation of the official budget which shall be charged is Business Unit NW051, Department ID G13, Div/Proj. M1310, Activity A, Account 72060, Budget Reference B2013.
  1. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.
  1. There shall be no amendment or changes to this contract without approval of the Municipal Council of the City of Newark.
  1. The Acting Deputy Director of NewarkWORKS shall file forthwith a copy of the fully executed copy of the contract in the Office of the City Clerk and shall be made available for public inspection.
  1. This contract is being awarded to a non-profit organization and as such is not governed by the State-Pay-to-Play Law, N.J.S.A. 19:44A-20-5, or Newark Executive Oder on Pay-to-Play Reform, MEO-07-0001.
 
STATEMENT
 
Resolution ratifies and  authorizes the Mayor, and/or his designee(s), the Deputy Mayor/Director of the Department of Economic and Housing Development and Acting Deputy Director of Newark One Stop Career Center/NewarkWORKS to enter into and execute a contract with Children's Hospital of New Jersey (CHONJ) at Newark Beth Israel Medical Center, 201 Lyons Avenue, Newark, New Jersey  07112 pursuant to the provisions of WIA, to provide services in the areas of Academic Remediation training to forty (40) clients for a total not to exceed $117,320.00 for program year 2012-2013 (July 1, 2012 through June 30, 2013); grant funds must be fully expended by the City by June 30, 2014.
