Body
WHEREAS, the administration of the State-Operated Public Schools, in particular the Lafayette Street School, has requested the adoption of an Ordinance permitting school parking on certain residential streets adjacent to the Lafayette Street School, in order to avoid parking on the playground, thereby making it available to the students; and
WHEREAS, the Department of Engineering is desirous of adopting a School Permit Parking provision and to do so, sees a need to repeal Section 23:5-14, Parking by Permit Only in Designated Residential Areas (attached as an Exhibit to this Ordinance), and amend, supplement and re-adopt it as Section 23:5-14, Parking by Permit Only in Designated Residential Areas, Section 23:5-14.1 Business Permit Parking; and adding Section 23:5-14.2 School Permit Parking, for ease of interpretation.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
Section 1.  That Section 23:5-14, Parking by Permit Only in Designated Residential Areas, of Title 23, Traffic and Parking, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, be amended and supplemented by repealing and replacing that Section of the Ordinance with the following:
23:5-14. Parking By Permit Only, In Designated Residential Areas
a.      Vehicles Parked on Streets. No vehicle shall be parked on the streets or parts of streets listed below, Monday through Friday between the hours specified, unless:
      1.      The vehicle is owned or operated on a regular basis by a resident of that street, or
      2.      The vehicle is owned or operated on a regular basis by a faculty member of a school afforded School Permit Parking by this ordinance; or
      3.      The vehicle is a noncommercial owned or operated vehicle of the owner, manager or employee of a commercial establishment afforded Business Permit Parking by this ordinance; and
       4.      The vehicle has displayed on its rear view mirror, in such a manner as to be closely examined by an officer, a current residential, business or school parking permit.
      b.      Exempt Vehicles. The following shall be exempt from this Parking Permit Section:
      1.      Visitor. A vehicle displaying a current visitor parking permit may be parked a maximum of two (2) weeks within its designated permit by parking area. The visitor's permit shall be displayed on the dashboard of the vehicle in such a manner as to be clearly visible by an officer enforcing parking regulations.
      2.      Contractors' Service and Delivery Vehicles. Contractors' service and delivery vehicles bearing the names and address of a commercial business may be parked without a permit during the time service is being rendered or repairs are being made within the permit parking area.
      3.      Emergency Vehicles. Emergency vehicles, Public Service, Electric and Gas Co., and other public utility vehicles may be parked within the permit parking area during the time service is being rendered or repairs are being made within the permit parking area.
      c.      Designation of Permit Parking Areas. Whenever the Director of Engineering or a designee shall determine that certain streets or portions thereof exclusively or primarily servicing residential land uses are being used for parking by the operators of vehicles, who do not reside on the streets, and that the average number of such vehicles parking in such manner is in excess of twenty-five (25%) percent of the number of parking spaces on such streets and that the total number of parking spaces actually occupied exceeds sixty-five (65%) percent of the total number of parking spaces on such street on the weekdays of any month, as disclosed by an engineering or traffic study, then the Director of the Department of Engineering or a designee shall recommend to the Municipal Council that such streets be included within this section.
      d.       Administration. Application for parking permits under this section shall be made in writing to the Director of the Department of Engineering or a designee. Permits shall be granted only under the following terms and conditions:
      1.      A permanent permit, valid for one (1) year, shall be issued for every vehicle owned or principally operated by the person, who is a resident on a street or portion thereof upon which parking is restricted by this section, with a maximum of two (2) permits issued to each residential unit.
      2.      A permanent permit shall be issued upon the provision of:
      (a)      Completed application of which the following information shall be printed on the application and supplied by the applicant in the City: applicant's name, address, telephone number, vehicle registration and license plate number; indicate homeowner/renter;
      (b)      Valid and current State of New Jersey Driver's License indicating an address on a street or portion thereof upon which parking is restricted by this section;
      (c)      Valid and current State of New Jersey Vehicle Registration indicating an address on a street or portion thereof upon which parking is restricted in this section;
      (d)      Valid and current State of New Jersey Insurance Certificate indicating an address on a street or portion thereof upon which parking is restricted by this section; and
      (e)      Proof of residency consisting of two (2) of three (3) current documents: utility bill, telephone bill, or water/tax bill indicating an address on a street or portion thereof upon which parking is restricted by this section.
      3.      There shall be a fee of ten ($10.00) dollars per year payable to the City of Newark by a certified check or money order, by each resident requesting a permit. This fee shall be collected by the Permit Office of the City of Newark.
      4.      A visitor parking permit, valid for a maximum of two (2) weeks, shall be issued to a person who is a resident on a street or portion thereof upon which parking is restricted by this section, for use by visitors to that residential unit, with a maximum of one (1) permit issued to a residential unit at any time.
      5.      There shall be a fee of fifteen ($15.00) dollars per visitor parking permit payable to the City of Newark by a certified check or money order, by each resident requesting a permit. This fee shall be collected by the Permit Office of the City of Newark.
      6.      There shall be a fee of thirty ($30.00) dollars, payable to the City of Newark by certified check or money order, to replace a permanent or visitor parking permit that has been lost or stolen. This fee shall be collected by the Permit Office of the City of Newark.
      e.      Permit Parking; Areas Designated.
      1.      No person shall park a vehicle on streets or parts of streets as described within the following sections unless an appropriate and current parking permit is issued by the City of Newark and displayed on said vehicle for those streets or parts of streets listed as follows: (Ord. 6-S+F-b, 1-3-07 § 1)

      f.      Notwithstanding anything to the contrary herein, any person, who has legal access to a garage (by lease or ownership) shall not be entitled to a residential parking permit. This section shall not apply to anyone, who is handicapped in accordance with the provisions of N.J.S.A. 39:4-204 and who has been issued a special vehicle identification card issued by the State Motor Vehicle Commission pursuant to the provisions of N.J.S.A. 39:4-205. 14.1      Business Parking Permit.
            a. Vehicles Parked on Streets Adjacent to Ferry Street Commercial Corridor. No vehicle shall be parked on the streets or parts of streets as identified below and as stipulated by Ordinance 6 S+F-m adopted October 3, 2001, between the hours specified, unless:
            1.      It is a noncommercial owned or operated vehicle of the owner, manager or employee of a commercial establishment, which is located on Ferry Street between New Jersey Railroad Avenue and Van Buren Street; and
            2.      The vehicle has displayed on its left rear window, in such a manner as to be closely examined by an officer, a current Business Parking Permit.
            b.      Administration.
            Application for Business Parking Permits under this section shall be made in writing to the Director of the Department of Engineering or a designee. Permits shall be granted only under the following terms and conditions:
            1.      A permanent permit, valid for one (1) year, shall be issued for every noncommercial vehicle owned or principally operated by a person, who is an owner or employee of a business on Ferry Street between New Jersey Railroad Avenue and Van Buren Street.
            2.      Five (5) permits shall be issued to each business unit for use by owners or employees of that business.
            3.      There shall be a fee of five ($5.00) dollars per year payable to the City of Newark by certified check or money order, for each business permit. This fee shall be collected by the Permit Office of the City of Newark.
            4.      There shall be a fee of thirty ($30.00) dollars, payable to the City of Newark by certified check or money order, to replace a permit that has been lost or stolen. This fee shall be collected by the Permit Office of the City of Newark.
            c. Business Permit Parking: Areas Designated.

            1.      It is a noncommercial owned or operated vehicle of the owner, manager or employee of a commercial establishment which is located on Halsey Street between Washington Place and Raymond Boulevard; and
            2.      The vehicle has displayed on its rear view mirror, in such a manner as to be closely examined by an officer, a current Business Parking Permit.
            (a)      Administration. Application for Business Parking Permits under this subsection shall be made in writing to the Director of the Department of Engineering or his designee. Permits shall be granted only under the following terms and conditions:
      (1)      A permanent permit, valid for one (1) year, shall be issued for every noncommercial vehicle owned or principally operated by a person, who is an owner or employee of a business on Halsey Street between Washington Place and Raymond Boulevard.
      (2)      A maximum of five (5) permits shall be issued to each business unit for use by owners or employees of that business.
      (3)      There shall be a fee of fifteen ($15.00) dollars per year payable to the City of Newark by certified check or money order, for each Business Parking Permit. This fee shall be collected by the Permit Office of the City of Newark.
      (4)      Each business must provide a copy of a current Business License in order to be granted a Business Parking Permit.
      (5)      If a permit is lost or stolen there will be a thirty ($30.00) dollar replacement fee.
      (b)      Business Permit Parking: Areas Designated.
      (1)      New Street: South side, between Broad Street and Halsey Street, from 9:00 a.m. to 5:00 p.m. Monday through Friday.
      (c)      Exempt Vehicles: The following shall be exempt from this Parking Permit subsection:
      (1)      Contractors' Service and Delivery Vehicles. Contractors' service and delivery vehicles bearing the name and address of a commercial business may be parked without a permit during the time of service is being rendered or repairs are being made within the permit parking area.
      (2)      Emergency Vehicles. Emergency Vehicles, PSEG, Verizon, Optimum Online and other public utility vehicles may be parked within the permit parking area during the time service is being rendered or repairs are being made within the permit parking area. (Ord. 6 PSF-q, 10-6-10)
 
14.2 3            School Permit Parking.
            a.  Vehicles Parked on Streets Adjacent to Lafayette Street School. No vehicle shall be parked on the streets or parts of streets as identified below and as stipulated by Ordinance 6 S+FM, adopted October 3, 2001, between the hours specified, unless:
                  1. It is a noncommercial vehicle owned or operated by a full-time employee of the Lafayette Street School, which is located at 205 Lafayette Street; and
                  2. The vehicle has displayed on its rear view mirror, in such a manner as to be closely examined by an officer, a current School Parking Permit.
                  b.  Application for School Parking Permits under this section shall be made in writing to the Director of the Department of Engineering or a designee.  Permits shall be granted only under the following terms and conditions:
                        1. A permanent permit, valid for one (1) year, shall be issued for every noncommercial vehicle owned or principally operated by a person, who is a full-time employee of the Lafayette School.
                        2.  There shall be a fee of twenty-five ($25.00) dollars per year, payable to the City of Newark by certified check or money order, for each school permit. This fee shall be collected by the Permit Office of the City of Newark.
                        3.  There shall be a fee of thirty ($30.00) dollars, payable to the City of Newark by certified check or money order, to replace a permit that has been lost or stolen.  This fee shall be collected by the Permit Office of the City of Newark.
      c.      School Permit Parking: Areas Designated.
                 1.  Congress Street: Both sides, between Lafayette Street and Market Street, from 9:00 a.m. to 5:00 p.m. Monday through Friday.
                      2. Prospect Street: Both sides, between Lafayette Street and Market Street, from 9:00 a.m. to 5:00 p.m. Monday through Friday.
14.3 1       Parking by Permit Only in Front of Privately-Owned Residential Driveways.
Section 2.      Regulatory signs shall be erected and maintained by the City of Newark.
Section 3.      Any Ordinance or parts thereof inconsistent with this Ordinance are hereby repealed as the context requires.
Section 4.      This Ordinance shall take effect upon final passage and publication and in accordance with the laws of the State of New Jersey.
Section 5.       This Ordinance does not require approval by the New Jersey State Commissioner of Transportation.
STATEMENT
This Ordinance repeals Section 23:5-14, Parking by Permit Only in Designated Residential Areas, of Title 23, Traffic and Parking, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, and amends, supplements and re-adopts it as Section 23:5-14, Parking by Permit Only in Designated Residential Areas, Section 23:5-14.1 Business Permit Parking; and adding Section 23:5-14.2, School Permit Parking.
