WHEREAS, the Division of Traffic and Signals, Department of Engineering, City of Newark, forwarded to the Star Ledger, a newspaper generally circulating in the City of Newark an advertisement for the receipt of bids on April 18, 2013, for Contract No. 13-2013, Installation of Pavement Markings on Various Streets; and
WHEREAS, on May 23, 2013, one (1) bid was received for Contract No. 13-2013, Installation of Pavement Markings on Various Streets, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, the bid was rejected because the Star Ledger failed to publish the newspaper advertisement on April 18, 2013 for Contract No. 13-2013, Installation of Pavement Markings on Various Streets.; and
WHEREAS, the Division of Traffic and Signals, Department of Engineering, City of Newark, re-advertised for the receipt of bids on July 2, 2013, for Contract No. 13-2013(R), Installation of Pavement Markings on Various Streets; and
WHEREAS, on August 1, 2013, three (3) bids were received for Contract No. 13-2013(R), Installation of Pavement Markings on Various Streets, in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and
WHEREAS, based on a review of the bids, the Director of the Department of Engineering desires to accept the bid proposal submitted by the lowest responsible bidder, Statewide Striping, Inc., 499 Pomeroy Road., Parsippany, New Jersey 07054 and execute Contract No. 13-2013(R), Installation of Pavement Markings on Various Streets for the total bid amount of $167,400.00.; and
WHEREAS, presently the amount of $75,000.00 is certified for this contract, and the Director of Engineering is authorized to extend the contract to its full value of $167,400.00, when the balance of the funds in the amount of $92,400.00 is certified, and a copy of the Certification of Funds will be filed with the Office of the City Clerk.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
- The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to accept the bid proposal submitted by the lowest responsible bidder, Statewide Striping, Inc., 499 Pomeroy Road., Parsippany, New Jersey 07054, and execute Contract No. 13-2013(R), Installation of Pavement Markings on Various Streets, for the total bid amount of $167,400.00.
- No amendments or modifications to this contract are allowed without prior Municipal Council approval.
- A fully executed copy of the contract shall be filed in the Office of the City Clerk by the Director of the Department of Engineering.
- This contract is to be completed within a period of 365 consecutive calendar days from issue of a formal Notice to Proceed by the Director of the Department of Engineering.
- The public bidding process under the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq., complies with the Fair and Open Process of the State of New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq.
6 Pursuant to N.J.A.C. 5:30-5.5, attached hereto is a partial Chief Financial Officer's certification which states the funds in the amount of $75,000.00 are available in the 2013 Budget, Fund 011, Agency 110, Organization 1107 and Object 71980.
7. The certification shall be filed along with the original resolution and the executed contract in the Office of the City Clerk. The remainder of the funding for this contract ($92,400.00) will be subject to appropriation in the 2014 Municipal Budget (or Temporary Budget); and funds will be certified prior to services being provided by the contractor.
8 The Director of the Department of Engineering is further authorized to extend this contract to its full value of $167,400.00, when the balance of the funds in the amount of $92,400.00 is certified, and a copy of the Certification of Funds will be filed with the Office of the City Clerk.
STATEMENT
This resolution authorizes the Mayor and/or his designees, the Director of the Department of Engineering to accept the bid proposal submitted by the lowest responsible bidder, Statewide Striping, Inc., 499 Pomeroy Road., Parsippany, New Jersey 07054, and execute Contract No. 13-2013(R), Installation of Pavement Markings on Various Streets, for the total bid amount of $167,400.00.
