WHEREAS, with the Occupational Safety and Health Act of 1970, Congress created the Occupational Safety and Health Administration (OSHA) to assure safe and healthful working conditions for working men and women by setting and enforcing standards and by providing training, outreach, education and assistance; and
 
WHEREAS, the City of Newark Department of Child and Family Well-Being wishes to develop and maintain a level of preparedness that meets the OSHA Guideline for Level B preparedness and response to biological, chemical  or radiological events; and
      
WHEREAS, the Contractor, Saint Michael's Medical Center, has represented that  they are qualified by training and experience to provide the services in the manner and the terms and conditions set forth in the proposed contract; and
 
WHEREAS, Saint Michael's Medical Center agrees to maintain a level of preparedness that meets OSHA Guidelines for Level B preparedness; and
 
WHEREAS, the City of Newark Department of Child and Family Well-Being, entered into a contract with Saint Michael's Medical Center, pursuant to Resolution 7R2-e adopted June 17, 2009, to maintain a level of preparedness that meets OSHA Guidelines for Level B preparedness, for the period of January 1, 2009 through December 31, 2009, with an option to renew for years 2010, 2011, 2012 and 2013; and
 
WHEREAS, the City of Newark Department of Child and Family Well-Being, has exercised the option to renew the contract pursuant to Resolution  7R2-a June 3, 2009, to maintain a level of preparedness that meets OSHA Guidelines for Level B preparedness for the years 2010, 2011, and 2012 (see attached renewals); and
 
WHEREAS, the City of Newark desires to exercise the option to renew the contract for the period of January 1, 2013 through December 31, 2013, in the amount of fourteen thousand four hundred sixty six dollars and no cents ($14,466.00); and
 
WHEREAS, it is understood by Saint Michael's Medical Center that the contract is subject to availability of funds from the Newark Metropolitan Medical Response System (MMRS); and
 
WHEREAS, the original contract was awarded pursuant to the Fair and Open process N.J.S.A.19A-20.5, pursuant to Local Public Contracts Law N.J.S.A.40A:11-4.1(3) (f), and is in compliance with Executive Order MEO-07-0001, effective March 31, 2007.
 
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Director of the Department of Child and Family Well-Being, is hereby authorized to exercise the option to renew the contract and execute a contract with Saint Michael's Medical Center to maintain a level of preparedness and response to biological, chemical or radiological events, for the contract period of January 1, 2013 through December 31, 2013, in the amount of fourteen thousand four hundred sixty six dollars and no cents ($14,466.00).
 
2.      Attached hereto is a Certification of Funds which state that there are available legally appropriated funds for the purposes set forth hereinabove in the total amount of fourteen thousand four hundred sixty six and no cents ($14,466.00), and that the line appropriation of the official budget which shall be charged is as follows: Business Unit, NW051, Dept. ID, G12, Div./Proj. 2H230, Activity A, Acct. No. 71280, Budget Ref. B2012;
 
3.      The original contract was awarded pursuant to the Fair and Open process N.J.S.A.19A-20.5,  and as competitive bidding contract pursuant to Local Public Contracts Law N.J.S.A.40A:11-4.1(3)(f), a contract of this type must be available for public inspection, and is in compliance with Executive Order MEO-07-0001, effective March 31, 2007.
 
 
4.      Pursuant to N.J.S.A.27:25-17, any and all debts, expenses or obligations incurred by the Department of Child and Family Well-Being shall be payable only from funds available to the City of Newark, and no liability or obligation shall be incurred by the Department of Child and Family Well-Being beyond the extent to which monies are available.
 
5.      A notice of this action shall be printed in a local newspaper as required by law within by ten (10) days hereof.
 
6.      A copy of the proposed Contract is attached hereto.
 
7.      A copy of the executed contract shall be filed in the Office of the City Clerk by the Director of the Department of Child and Family Well-Being.
 
STATEMENT:
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of Child and Family Well-Being, to exercise its option to renew and execute a contract with Saint Michael's Medical Center to maintain a level of preparedness and response to biological, chemical or radiological events, for the period of January 1, 2013 through December 31, 2013, in the amount of fourteen thousand four hundred sixty six and no cents ($14,466.00).
