WHEREAS, the City of Newark is the owner of the following properties:

      WHEREAS, Public Service Electric and Gas ("PSE&G"), 80 Park Plaza, T6B, Newark New Jersey 07102-4194, has requested a Right of Entry Agreement to access the Property at various locations, according to the terms and conditions of the Right of Entry Agreement attached hereto and made a part hereof, to carry out their 5018 project consisting of upgrading their internal communication system by removing top 2 shield wires above the conductor and replacing them with an Optical Grounding Wire.  The new grounding will serve the following two functions: (1) to perform lightening protection and (2) to serve as a path of communication for the relay protection that protects the line in the event of a fault; and
 
      WHEREAS, the City of Newark wishes to enter into a Right of Entry Agreement with PSE&G, according to the terms and conditions of the Right of Entry Agreement attached hereto and made a part hereof, to allow them to carry out the above purpose.
 
       NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designees, the Business Administrator and/or the Deputy Mayor/Director of the Department of Economic & Housing Development are hereby authorized to execute a Environmental Right of Entry Agreement with PSE&G, 80 Park Plaza, T6B, Newark New Jersey 07102-4194, in the form attached hereto and made a part hereof, to access the following City-owned properties to carry out their 5018 project consisting of upgrading their internal communication system by removing top 2 shield wires above the conductor and replacing them with an Optical Grounding Wire.  The new grounding will serve the following two functions: (1) to perform lightening protection and (2) to serve as a path of communication for the relay protection that protects the line in the event of a fault.

2.      The term of this Right of Entry Agreement shall commence on the date that this agreement is authorized by the Municipal Council or October 1, 2013, whichever comes first, and shall be terminated on February 28, 2014.
 
3.      The City of Newark Municipal Council hereby ratifies this agreement from October 1, 2013 to the date of adoption of this authorizing resolution.
 
4.      No Municipal funds shall be expended or are required under this resolution.  
 
5.      The Deputy Mayor/Director of the Department of Economic & Housing Development shall be responsible for the enforcement of the conditions of the Right of Entry Agreement.
 
6.      A copy of the Environmental Right of Entry Agreement and this Resolution shall be filed in the Office of the City Clerk as attached hereto.

Resolution authorizing and ratifying a Right of Entry Agreement between the City of Newark and PSE&G, for the following properties, Block 60, Lot 15 - Hardyston, New Jersey, Block 43, Lot 2 - Hardyston, New Jersey, Block 566, Lot 1 - Jefferson, New Jersey-- Block 16906, Lots 3 &4 - West Milford, New Jersey, Block 15101, Lot 9 - West Milford, New Jersey-- Block 15001, Lot 6 - West Milford, New Jersey, for the purposes of upgrading their internal communication system, according to the terms and conditions of said agreement, in the form attach hereto from October 1, 2013 through February 28, 2014.
