WHEREAS, Resolution No. 7R4-A, adopted September 6, 2012, authorized the Director of the Department of Engineering to accept the bid proposal and execute Contract No. 11-2011, Various Streets (11 Locations) - 2011 Project, with Granada Construction Corp., 147 Thomas Street, Newark, New Jersey 07114, for the amount of $2,069,182.05; and
 
WHEREAS, the Department of Engineering needs to increase existing quantities for drainage repairs, concrete curb, asphalt and striping due to unforeseen conditions.  These additional work items are necessary in order to complete the ongoing work along the streets under the original contract; and
 
WHEREAS, the Director of the Department of Engineering has certified that the change order is allowed pursuant to the regulations governing construction contract change orders, more specifically, N.J.A.C. 5:30-11.1, et seq., and do not constitute a material expansion in the size, nature or scope of the Project and the extra work cannot be reasonably effectuated by a separately bid contract without unduly disrupting the basic work; and
 
WHEREAS, the Department of Engineering also needs to extend the time of the contract performance and must therefore extend the contract termination date to June 1, 2014; and
 
WHEREAS, the attached Change Order No. 1 to Contract No. 11-2011, Various Streets (11 Locations) - 2011 Project, increases the contract amount by $100,000.00, thereby bringing the total amount of this contract to $2,169,182.05.
 
      
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Director of the Department of Engineering is hereby authorized on behalf of the City of Newark to issue and approve Change Order No. 1 to Contract No. 11-2011, Various Streets (11 Locations) - 2011 Project, to increase existing quantities for drainage repairs, concrete curb, asphalt and striping due to unforeseen conditions for the increased amount of $100,000.00, thereby bringing the total amount of this contract to $2,169,182.05.
 
2.      The contract period is amended to provide for a contract extension through June 1, 2014.
 
3.      Attached hereto are Certifications of Funds issued by the Chief Financial Officer, of the City of Newark, which states that there are available sufficient legally appropriated funds in the amount of $100,000.00 for the purpose set forth hereinabove.  A copy of these Certification of Funds shall be filed in the Office of the City Clerk by the Director of the Department of Engineering together with this resolution.
 
4.      A fully executed copy of Change Order No. 1 to Contract No. 11-2011, shall be filed in the Office of the City Clerk by the Director of Engineering.
 
5.      Consistent with the provisions of the Local Public Contracts Law, N.J.S.A. 40A-11-15(9), the Director of the Department of Engineering is authorized to extend the period in which to complete this contract to June 1, 2014.
 
6.      No other changes to this contract are allowed without prior Municipal Council approval.
7. Funds for Change Order No. 1 to Contract No. 11-2011, Various Streets (11 Locations) - 2011 Project, in the amount of $100,000.00 is provided as below:
 
      Fund 026, Account 32070, Budget Year B2013
8. Notice of Change Order No. 1, in accordance with N.J.A.C. 5:30-11.9(c)(6), shall be published in the official newspaper of the municipality, which shall be filed in the Office of the City Clerk for inspection by the public.
 
 
STATEMENT
 
This resolution hereby authorizes the Mayor and/or his designee, the Director of the Department of Engineering to enter into and execute Change Order No. 1 to Contract No. 11-2011, Various Streets (11 Locations) - 2011 Project, to increase existing quantities for drainage repairs, concrete curb, asphalt and striping due to unforeseen conditions for the increased amount of $100,000.00, thereby bringing the total amount of the contract to $2,169,182.05 and extending the contract period through June 1, 2014.
